Photo Release
I hereby authorize NCDC, Inc. to record my child's picture and voice on photographs, films, or digital media and to edit these recordings at its discretion and to incorporate these recordings into movie and sound films on tapes, radio or television programs, and for publicity and fundraising purposes. I also agree that my child's photo may be posted on the NCDC, Inc. website. I acknowledge that no such promise of compensation was made by NCDC, Inc. I give NCDC, Inc. the absolute right and permission to use my child's photographs in promotional materials and publicity efforts. I release NCDC, Inc. their officers, employees, agents, and designers for violation of any personal or proprietary right I may have in connection with such use.
Liability Release - General- UPDATED
I hereby agree that the use of the services and facilities at Northern California Dance Conservatory included but not limited to the grounds is at my and my child's own risk. As a condition of my child's use of such services and facilities at Northern California Dance Conservatory, including but not limited to the grounds, I, on behalf of my child (and my child's heirs and assigns) expressly agree to forever discharge, waive and release Northern California Dance Conservatory, its directors, management, staff, agents, employees, and/or independent contractors and their heirs, successors, and assigns from any and all claims, demands, injuries, liabilities, actions, causes of action arising from all acts of active or passive negligence on the part of Northern California Dance Conservatory and their heirs, successors and assigns on account of any and all injuries or damages, including but not limited to bodily injury, mental injury and/or property damage from any event, mishap, accident, loss, damage or injury suffered by myself or my child resulting from or connected with or caused by the use of the services and facilities at Northern California Dance Conservatory included but not limited to the grounds/ property at 920 Reserve Drive in Roseville, CA 95678. I further agree to defend, indemnify and hold harmless Northern California Dance Conservatory and its Directors management, staff, agents, employees, and/or independent contractors and their heirs, successors, and assigns from any and all claims, losses, and liabilities arising from my/or my child's or children's negligent or unlawful conduct and use of the services and facilities of Northern California Dance Conservatory.
Release of Liability - COVID-UPDATED
In consideration for receiving permission to BE ON PREMISES at Northern California Dance Conservatory Inc. (hereinafter the"Activity or Activities"), I, on behalf of myself and any minor dancer for whom I have the capacity to contract, hereby acknowledge and agree to the following:
1. I understand the hazards of the novel coronavirus ("COVID-19") and am familiar with the Centers for Disease Control and Prevention ("CDC") guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.
2. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in Activities.
3. I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and any minor children/dancer from whom I have the capacity to contract) Northern California Dance Conservatory Inc. its owners, staff, directors, coaches, employees and assigns (the "RELEASEES") from any liability related to COVID-19 which might occur as a result my being on the premises and participating in the Activities.
4. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. This Agreement and the provisions contained herein shall be construed, interpreted, and controlled according to the laws of the State of California. THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT THE PERMISSION GRANTED BY RELEASEES TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES. IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by the same.
5. By signing below I acknowledge all the above stated and also have read and agree to abide by all the Northern California Dance Conservatory Inc. reopening procedures, rules, and guidelines.
Medical Release
I hereby give my permission to the management, faculty, and staff of NCDC, Inc. to authorize any emergency medical care that may be required during my child's participation in classes, performances, or any NCDC, Inc. related event. I understand that I am responsible for any and all charges as a result of such care or medical treatment. I declare and affirm that my child is in good medical and physical condition, and the use of the services and facilities at Northern California Dance Conservatory does not pose any danger to my child's health. I further agree to abide by the rules and regulations of Northern California Dance Conservatory as they now exist or may be amended by the discretion of Northern California Dance Conservatory.
Drop Policy & Make-ups
The office must be notified in writing by the 15th of the month prior to the month you wish to stop classes. This can be done by emailing info@ncdc.com or by stopping at the front office and filling out a front desk slip. This will stop tuition from automatically being taken out of your account the following month.
(ex: you want to drop classes starting in May, you would need to notify the office by April 15th).
There are no make-up classes for classes you are unable to attend.
Class Credit/Refunds
There are no refunds of tuition for classes you are scheduled to attend and are unable to attend. There are also no refunds on any fees related to registrations or fees related to shows or productions. In the event NCDC can not for whatever reason offer in-person class instruction, NCDC will offer make-up classes or post a credit onto your NCDC account for all services and products not received.
Payment Policy
I hereby authorize NCDC to charge my credit card on file for all tuition fees, event fees, and other class-related fees. Tuition fees are due on the 1st of each month and will be automatically deducted.
•Tuition payments made after the 10th of the month will be subject to a $25 late fee.
•Tuition more than 20 days past due may result in a student not being allowed to participate in their class.
•All account charges, including tuition, must be paid in full for your student to participate in performances.
•NO CHECKS ARE ACCEPTED.
Tuition is charged monthly regardless of the number of weeks in the month. We do not charge more for the months with 5 weeks nor do we prorate for vacations or holidays.
