Assumption of Risk
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT")
Performing Arts Centre, Inc., 1538 Country Club Plaza Drive, St. Charles, MO 63303 (PAC) ("RELEASEES")
I represent that I (individually or on behalf of my child) understand the nature of this activity and that I am qualified, in good health and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe or I am unable to safely perform any activity, I will immediately discontinue in the activity.
I fully acknowledge, understand, appreciate and agree, that this activity, be it live class on property or virtual via Zoom (or similar application), involves risks of serious bodily injury, including permanent disability, paralysis and death which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the Releasees named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibilities for losses, costs and damages I incur as a result of participation in the activity.
I further acknowledge, understand, and appreciate, and agree that my participation may result in possible exposure to and illness from infection diseases, including but not limited to MRSA, INFLUENZA, AND COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others and assume full responsibility for participation and exposure.
I hereby release, discharge, and covenant not to sue your business, its administrators, directors, agents, officers, volunteers, employees, contractors, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of the premises on which the activity takes place, (each considered one of the "RELEASEES" herein) from all liability claims, demands, losses, damages, on my account caused or alleged to be caused in whole or in part by by the negligence of the RELEASEES or otherwise, including negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the RELEASEES, I will indemnify, defend, and hold harmless each of the RELEASEES from any loss, liability, damage, or cost, which any may incur as the result of such a claim.
Release of Liability
I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFY AGREEMENT and I understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of the Agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
PARENT CONSENT: I, hereby covenant and promise that I am the minor's parent and/or legal guardian, and behalf of myself and the minor, understand the nature of the above referenced activities and the minor's experience and capabilities and believe the minor to be qualified to participate in such activity. I further understand the risk of exposure to injury and/or infectious diseases, for myself and my child, as a participant, spectator at events, classes, or our presence at the facility or via Zoom. I hereby release, discharge, covenant not to sue and AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS each of the RELEASEES from all liability, claims, demands, losses or damages on the minor's or my account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise, including, but not limited to injury, negligent rescue operations, and/or exposure to infectious diseases and I further agree that if, despite this release, I, the minor, or anyone on acting on the minor's behalf makes a claim against any of the above RELEASEES, I WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS, each of the RELEASEES from any litigation expenses, attorney fees, loss liability, damage, or cost which any RELEASEE may incur as the result of any such claim.
PAC Health & Safety Protocol
FOR ALL DANCERS:
~Drop off your dancer at the front entrance no more than 5 minutes prior to class time. There may be a line; please stay six-feet-safe and be patient. (If absolutely needed, parents of 3-4 yr olds may escort their child into the building; exit when they go to class. Please wear a mask.)
~PAC Staff will take your temperature and spray your hands with hand-sanitizer.
~Dancers will be directed to their classroom or a socially distanced waiting area.
~In the classroom, Dancers go to their assigned "Parking" Spot where they will change their shoes before, during and after class.
~Dancers will also be assigned a "Dancing" Spot that is six-feet safe!
~After class, dancers will line up six-feet-safe at the side door to exit.
~Parents: Please park in the front lot & walk to the side entrance to pick up your child. (The side parking is reserved for PAC Faculty & Staff.)
FOR OUR STUDENTS WHO DRIVE THEMSELVES TO PAC:
~Please park in the front lot, leaving the side parking for our teachers & staff.
~Maintain social distancing in the parking lot.
~Follow the procedures outlined above.
~You will also exit using the side entrance.
~You must practice Social-Distancing while on PAC property. This includes inside & outside the studio, as well as the parking lot.
WHO SHOULD STAY HOME:
~Any dancer who is ill. (Fever, chills, coughing, sneezing, runny nose, shortness of breath, difficulty breathing, new loss of taste or smell, etc) Must be free of symptoms for 72 hours before returning to PAC.
~You have been diagnosed with COVID-19 within the past 14 days.
~You have been in close contact with someone who has been diagnosed with COVID-19 within the past 14 days.
MASKS:
~Masks are optional for all children. If you are requiring your child to wear a mask, please make sure the teacher knows if they have permission to take it off.
~Acro teachers will wear a mask when spotting students.
~Adults are asked to wear masks in all common areas.
SANITIZING:
~PAC will disinfect ballet barres and acrobatic mats between classes.
~PAC will disinfect all "high-contact" areas often.
~Beginner levels will purchase their own bag of props to eliminate "shared" items.
IF YOU CANNOT COMPLY WITH ALL OF THESE PROCEDURES WE ASK THAT YOU ALSO STAY HOME.
PAC parents are entrusting us with their precious children; We will not let them down!
Photo Release
I, hereby, grant Performing Arts Centre permission to use my child's photograph/video for promotional purposes and/or social media and Performing Arts Centre's website.
Payment Policy
Family Registration Fee is $25 annually. A $5 discount is given if paid by the posted "Early Bird" date.
Tuition is the same for every month. September through June (Recital). For lessons missed due to illness, holidays or inclement weather, please take a make-up lesson as soon as possible.
Tuition is due on the 1st of the month. On the first of each month, PAC will automatically charge your monthly tuition amount to your credit card.
A $25 fee will be charged to your account for any checks returned for any reason.
A $25 fee will be charged to your account for any declined credit card payment. You must immediately supply us with another credit card or routing number.
A 5% discount is offered for Semester or Annual payments. First Semester is September - January; Second semester is February - June (Recital).
