-I understand that all rehearsals, both in class and otherwise, are required and that my student will be in attendance unless we have acquired an excused absence in advance.

-I confirm that my student will be in attendance for recording on either November 8, 2020 or November 9, 2020: rotation dates to be confirmed closer to filming
--Please make certain your student's T-shirt size for their Nightmare Before Christmas production T-shirt is entered into their account. (Price included in production fee!)
-I/We have received and read the Nightmare Before Christmas Production Information Packet.
-I/We acknowledge that by submitting a production registration form and production fee that I/We are making a commitment to 2020 Nightmare Before Christmas production, are aware of the expectations, and agree to fulfill our commitment.
-I/We agree to the Nightmare Before Christmas Participation Fee of $100 for Mighty Mini Movers and Pre Ballet students and $225 for all students Levels 1-5, ADV/INT and PEP.

LDI Waiver of Liability
I have voluntarily elected to participate in and/or allow my minor child to participate in activities and events offered through the Lynch Dance Institute (LDI) located at, 12227 Poway Road, Poway, California 92064 or other performance venues. In consideration for being allowed to participate in classes and use LDI facilities and equipment, I represent, acknowledge and agree as follows:
GENERAL RELEASE
I acknowledge and agree that this Agreement covers and is intended to release and provide other benefits and legal protections to LDI and its respective and collective agents, owners, faculty, employees, volunteers, guest instructors, insureds, and all other persons or entities acting in any capacity on behalf of LDI (Released Parties).
RELEASE OF POTENTIAL INJURIES
I acknowledge and agree that there are risks of physical injury associated with, arising out of, and inherent to the sport of dance as well as other activities and events engaged in with LDI. These risks include but are not limited to stress fractures, sprains, broken bones, other serious physical injury, damage, or other exertion related medical events. I understand that such risks simply cannot be eliminated. I acknowledge and agree that, while the dance and other activities that take place through LDI are supervised by LDI faculty and guest instructors, it is not feasible for such employees to monitor the activities and actions of all participants at all times or all participants simultaneously. Furthermore, LDI faculty have difficult jobs to perform. They seek safety, but they are not infallible.
VOLUNTARY ASSUMPTION OF RISK AND RELEASE OF LIABILITY
I acknowledge and agree that all participation is voluntarily at my own (or my child's own) risk. I forever, irrevocably and unconditionally release, discharge, and waive all right and/or causes of action of any kind against all Released Parties from any and all liability, of whatever kind or nature, including any claims of negligence, in law, equity or otherwise, whether now known or unknown, related to or arising, directly or indirectly, from my participation or my child's participation in LDI events and activities and use of LDI equipment. I understand that this release and waiver applies to and includes all activities, whether inside or outside the LDI studio, at a performance venue or other location, in person or through an online platform or website.
AGREEMENT TO PAY MY OWN MEDICAL EXPENSES
I acknowledge, accept, and assume the risk of any and all medical conditions, limitations, or disabilities (whether temporary or permanent), whether known or unknown, which might contribute to or exacerbate any injury I or my child might sustain. I acknowledge and agree that if medical assistance of any form, including but not limited to emergency care, hospitalization, out-patient care, and/or physical therapy is required or performed as a result of any injury such assistance shall be at my own expense.
CALIFORNIA CIVIL CODE SECTION 1542
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
ARBITRATION OF DISPUTES; TIME LIMIT TO BRING CLAIM
I waive my right, or the right of my child, to maintain a lawsuit against LDI and the other Released Parties for any and all claims covered by this agreement. By agreeing to arbitrate, I understand that neither I nor my child will have the right to have any claim determined by a jury. Any dispute, claim or controversy arising out of or relating to my or my child's participation at LDI and use of its facilities and equipment, including the determination of the scope or applicability of this agreement to arbitrate shall be brought within one year of the date of the alleged injury and be determined by arbitration in San Diego County California before one arbitrator. The Arbitration shall be administered by JAMS pursuant to its Rule 16.1 for expedited arbitration rules and procedures. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. I understand and acknowledge that the JAMS Arbitration Rules to which I agree are available online for my review at jamsadr.com, and include JAMS Comprehensive Arbitration Rules & Procedures; Rule 16.1 Expedited Procedures; and, Policy On Consumer Minimum Standards Of Procedural Fairness.
TERM OF AGREEMENT
By signing below, I represent and warrant that I have read each and every paragraph in this document and agree to be bound by the terms stated, including the release of liability. I understand that this agreement extends forever into the future and will have full force and legal effect.
IN SUMMARY, BY MY SIGNATURE BELOW, I ACKNOWLEDGE THAT IF AN INJURY OCCURS IN ANY WAY THROUGH PARTICIPATION IN LDI INSTRUCTION, ACTIVITIES, OR EVENTS THIS WAIVER PREVENTS AND PROHIBITS ANY RECOVERY OF MONEY FROM LDI OR ANY OTHER RELEASED PARTY.
If am the parent, legal guardian, or power-of-attorney of the Participant, by signing below, I represent and warrant that I have the authority to execute this Agreement.

LDI Code of Conduct Agreement - Evening Program
STUDENTS
WORK ETHIC: I understand that my continued participation in the PEP program is dependent upon my commitment to the program and my personal growth. I agree to arrive to class on time, to treat myself, my educators, and my peers with respect; and to promote a supportive and healthy learning environment.
ATTENDANCE: : I understand that attendance is mandatory in all classes and the continuity of my education is imperative to my personal success and to the overall productivity of this program. Barring emergent situations, last minute and unexcused absences will not be tolerated. As such, I agree to communicate all class and rehearsal conflicts directly to the teacher, Ms. Dickson, or Mr. Lynch.
CELL PHONE USE: LDI is a phone free zone. Cell phone usage is not permitted inside the building by students or parents.
INJURY: Should I sustain an injury that may prohibit me from physically participating in class I understand that I am expected and required to attend and observe my regularly scheduled classes unless I am otherwise excused by my instructor.
LDI CONTENT: I understand that any and all class materials, content, exercises, and compositions are the intellectual property of the Lynch Dance Institute and I will refrain from recording and/or posting said materials to social media unless I have acquired the expressed consent of LDI and/or my class instructor.
DRESS CODE - BALLET:
Girls: Hair must be in a bun. Ponytails for ANY ballet classes, Pre Ballet and up, will not be permitted. All dancers must wear a black leotard (NO leotards with attached skirts!) with pink seamed tights and pink ballet shoes. Adv/Int students may wear bullet skirts for pointe and variations classes.
Boys Basics Class: All dancers must wear an LDI T-shirt, shorts, and socks or bare feet.
Boys: All dancers must wear black tights with white ballet shoes, white socks, and a white shirt.
DRESS CODE - CONTEMPORARY - MODERN - JAZZ - TAP:
All dancers are permitted to wear age appropriate, non baggy, comfortable clothing. Hair must be pulled back and neat.
Mighty Mini Movers: All dancers will require ballet shoes (or bare feet) and black tap shoes
Jazz: All dancers will require black jazz shoes
Tap: All dancers will require black tap shoes
Commercial Jazz: All dancers will require 3" T-Strap Tan character heels

PARENTS
HANDS ON APPROACH: Due to the physical nature of the education provided at LDI, I/WE understand that I/MY CHILD may receive hands on corrections and/or adjustments from LDI staff as a part of their educational in class experience. By signing below, I/WE give our expressed consent to in class hands on corrections and adjustments.
*I/WE elect to refuse any/all hands on corrections and adjustments by initialing here.
PHOTO RELEASE: I acknowledge and consent to allow Lynch Dance Institute to use: photos and/or videos of my child/myself in publications (such as flyers/brochures), advertisements (such as newspapers or online ads), our studio's website, or on social media sites (such as the studio's Facebook or Instagram account). I understand that in some cases, my child and/or my name may be used. I further understand no financial compensation will be for use of these photos/videos.
FINANCIAL COMMITMENT: I acknowledge that, should I choose to discontinue my participation for the 2020-2021 season, I am required to give a minimum of 30 days written notice. During the duration of my student's enrollment I acknowledge that I/We are financially responsible for timely tuition payments. All tuition payments are due the 1st of every month. Any tuition paid after the 5th will be subject to a $50 late payment fee.
PRODUCTION FEES: All students participating in our Mixed Nuts holiday production and the end of year performance are required to pay all production participation fees.
REGISTRATION:
To reserve your position in the program you must submit a non-refundable deposit of 20% of your annual tuition, plus $45, for your 2020-2021 season registration fee.
By signing below, both student and parent acknowledge they have read, understand, and agree to uphold the Lynch Dance Institute's Code of Conduct guidelines as listed above.
COVID-19 Policy
We are excited to get back into the studio and start dancing again! We have missed each and every one of them. As we transition back into the studio, we wanted to provide you with as much information as we can to help you and your dancer feel safe and comfortable.
Below are the protocols and procedures we are implementing so you can see that we are taking every precaution we reasonably can, and following the recommendations put forth by our local and state health officials.

Studio Health and Safety Procedures
1. Physical distancing
• All dancers must be 6 feet apart during the entirety of class.
• Spaces will be marked on the floor of each studio.
• No touching or physical interaction of any kind can take place during class.
• Only 8-10 students allowed in each studio at a given time depending on the studio
-> 8 in studio A, 10 in the studio B
• If a class has more dancers than the allotted spots in the studio, there will be a rotation schedule of dancers in class from week to week- all other students will take class on Zoom.
• Dancers must RSVP to class for their "in-studio spot" so we can make sure they are coming otherwise their spot will be given to another student.
• Please don't congregate outside the studios.
• Face coverings are required at all times.
2. Enhanced cleaning and disinfecting procedures
• Floor cleaned each day
• Barres, door handles cleaned between classes
• Studio is being professionally deep-cleaned twice per week in addition to our hourly cleanings.
• Students and teachers will wash hands before and after each class.
3. Belongings
• All belongings must stay with the student in the studio.
4. Waivers/Safety
• All dancers and teachers must sign a legal Covid-19 waiver in order to participate in "in¬ studio" classes. (SEE BELOW)
• We are asking all parents to take their child's temperature at home to make sure they don't have any symptoms of a fever prior to their arrival at the studio.
• Anyone with symptoms of any sickness should stay home.
• We will also be taking temperatures before entry into the studio. Anyone with a fever will not be allowed in class until the fever is cleared for 24 hours.
• Students will be required to arrive wearing their dress code you will not be permitted to change at the studio.
• Markings will be placed at least six feet on sidewalks at the building entrances, with signs directing to use the markings to maintain distance.
• The lobby will not be open to parents/guardians. Please find alternate places to wait for your child to finish class.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 i extremely contagious and is believed to spread mainly from person-to-person contact. As a result, the CDC along with federal and state health agencies still recommend practicing social distancing. Lynch Dance Institute, Inc has put in place preventative measures to reduce the spread of COVID-19; however, they cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending class at the studio could increase your risk and your child(ren)'s risk of contracting COVID-19.
Furthermore, I represent and warrant that Minor Child does not suffer from any medical condition or disease that might in any way hinder or prevent Minor Child from receiving the Services, including, to my knowledge, COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and I voluntarily agree to assume all of the risks and accept sole responsibility for my child(ren) and I may we be exposed to or infected by COVID-19 by attending classes at Lynch Dance Institute, Inc, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Lynch Dance Institute may result from the actions, omissions, or negligence of myself and others, including, but not limited to, studio teachers, volunteers, and other program participants and their families. I hereby release and agree to hold Lynch Dance Institute, Inc LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the studio, or that may otherwise arise in any way in connection with any services received from Lynch Dance Institute, Inc LLC.
I attest that:
* My dancer is not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* My dancer has not traveled internationally within the last 14 days or traveled to a highly impacted area within the United States of America in the last 14 days.
* I further acknowledge that Lynch Dance Institute, Inc LLC has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
* I further acknowledge that Lynch Dance Institute, Inc. LLC cannot guarantee that I will not become infected with the Coronavirus/Covid-19.
* I voluntarily seek services provided by Lynch Dance Institute, Inc LLC and acknowledge that my dancer increasing his/her risk to exposure to the Coronavirus/COVID-19.
* I acknowledge that my dancer must comply with all set procedures to reduce the spread of attending classes at Lynch Dance Institute, Inc LLC.
* I do not believe I or my child have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not nor has my child been diagnosed with Coronavirus/COVID-19 and not yet cleared as non-contagious by state or local public health authorities.
* I and my child am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
This liability waiver and release extends to the studio together with all owners, partners, and teachers.
Covid-19 Protocol
Lynch Dance Institute COVID PROTOCOL Parent Statement
1. You will check with your child each morning of class participation for signs of illness. If your child has a temperature of 100.4 degrees or higher, they will not be allowed to go to class.
2. Make sure your child does not have a sore throat or other signs of illness, like a cough, diarrhea, severe headache, vomiting, or body aches.
3. If your child has had close contact to a COVID-19 case, they will not be allowed to go to class. You must disclose to the staff any potential exposure that may have occurred through travel or other community spread. Please follow CDC guidance on what to do when someone has known exposure.
Review and practice proper hand washing techniques at home, especially before and after eating, sneezing, coughing, and adjusting a mask or cloth face covering with your child.
Talk to your child about precautions to take. Children may be advised to:
Wash and sanitize their hands more often.
Keep physical distance from other students.
Wear a mask. (Label your child's masks clearly in a permanent marker so that they are not confused with those of other
children)
Avoid sharing objects with other students, including water bottles, devices, writing instruments, and books. Use hand
sanitizer (that contains at least 60% alcohol.) Make sure you're using a safe product.
You agree to abide by the above and immediately inform a staff member of Lynch Dance Institute of any issues or concerns with regard to the above items.
