Assumption of Risk: General
We, the staff of Big CATS Gymnastics recognize our obligation to make our students and their parents aware of the risks and hazards associated with the sport of gymnastics, tumbling, cheerleading and strength training. Students may suffer injuries, possibly minor, serious, or catastrophic in nature. Gymnastics, tumbling, cheerleading and strength training can be dangerous and can lead to injury! Parents should make their children aware of the possibility of injury and encourage their children to follow all the safety rules and the coaches’ instructions. The parents should warn the child according to what the parent feels is appropriate. Big CATS Gymnastics will only ware the child through “Safety Messages”, our teaching style and progressions. Big CATS Gymnastics LLC, its coaches and other staff members, will not accept responsibility for injuries sustained by any student during the course of gymnastics, tumbling, cheerleading and open gym workouts, or in the course of any exhibition, competition or clinic in which he or she may participate in the programs offered by Big CATS Gymnastics.
I fully understand that Big CATS Gymnastics staff members are not physicians or medical practitioners of any kind. With the above in mind, I hereby release the Big CATS Gymnastics staff to render temporary first aid to my child or children in the event of any injury or illness and, if deemed necessary by the Big CATS Gymnastics staff, to call our doctor and to seek medical help, including transportation by a Big CATS Gymnastics staff member and/or its representatives, whether paid or volunteer, to any health care facility or hospital, or the calling of an ambulance for said child should the Big CATS Gymnastics staff deem this to be necessary.
I also understand that it is the parents’ responsibility to warn the child about the dangers of gymnastics and injury. I, my executors or other representatives, waive and release all rights and claims for damages that I or my child may have against Big CATS Gymnastics and/or its representatives whether paid or volunteer. I have further read and fully understand the information above and sign this waiver and release of liability and am fully aware of its content and meaning. This membership is non-refundable.
Medical Emergency, Photo/Video Permission, Personal Items
Dental & Medical Care Authorization:
I do hereby authorize a staff member of Big CATS Gymnastics to request to consent to any reasonable necessary medical or dental examination or treatment, including anesthesia, surgical and hospital care, to be rendered to the above named minor on the recommendation and supervision of any dentist, physician or surgeon licensed to practice medicine by any state.
Picture Use Permission:
I give permission to Big CATS Gymnastics to take pictures of my child and use them solely for the purpose of their web site or affiliate display. For use on the website, the full names of the participants will not be posted in order to insure the safety of the children.
Personal Items:
Big CATS Gymnastics is not responsible for any lost/stolen items, or damages to personal property brought to any operating site of Big CATS Gymnastics. We do have a Lost & Found Box for anyone seeking a lost item. Please see the front desk. Items left in the Lost & Found Box will be donated to a charity organization twice per year. Once in June & once in December
Payment Policies
-Your child is enrolled through the end of season (see season dates) UNLESS YOU FILL OUT A DROP FORM.
-Drop forms must be filled out 2 WEEKS PRIOR to drop date in order to discontinue charges. We do not issue refunds for paid tuition.
-You will be charged tuition whether your child misses or attends. You are paying for their spot in class. Make-up classes are always available.
-If paying by check, please add child's name on memo line.
-If paying by cash, please put cash in envelope with child's name on envelope.
-Tuition is due on the 1st of each month. A $10.00 late fee is added to accounts on the 5th.
-Big Cats will offer make-up classes wherever possible in the event of an inclement weather gym closure.
-Some months may have 3 weeks and some months may have 5 weeks. Most months will have 4 weeks. You are paying for the month regardless of how many weeks. *If there are less than 3 weeks in a month, Big Cats will offer make-up times to fulfill your tuition payment for that month but we will not charge extra for months that contain 5 weeks.
Assumption of Risk: COVID-19
The novel coronavirus, COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of certain sized groups of people.
Big Cats Gymnastics, LLC. ("the Gym") has put in place preventative measures to reduce the spread of COVID-19; however, the Gym cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Gym could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Gym and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Gym may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Gym employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at the Gym or participation in Gym programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Gym, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Gym, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Gym program.
