As the legal parent or guardian, I release and hold harmless Caliber Dance Company, its owners and operators from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon the premises or any premises under the control and supervision of Caliber Dance Company, its owners and operators or in route to or from any of said premises.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Caliber Dance Company (“Caliber”) has put in place preventative measures to reduce the spread of COVID-19; however, Caliber cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending classes at Caliber could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Caliber and that such exposure or infection may result in personal injury, illness, permanent disability and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Caliber may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Caliber employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Caliber or participation in Caliber classes or activities (“Claims”). On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge and hold harmless Caliber, its employees, agents, and representatives, of and from any Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Caliber, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during or after participation in any Caliber classes or activities.
Tuition is due by the 10th of every month. A $15.00 late fee will be applied to all accounts where tuition has not been paid by the 10th of the month. Caliber Dance Company accepts payment in the forms of cash, personal checks, cashier’s check, credit card, debit card and money orders for tuition. If tuition is not paid by the beginning of the following month, children will be asked to leave class until their tuition balance is paid in full. If tuition is late for the 10th of the month deadline 2 times in one calendar year, it will become mandatory that a credit card is kept on file with Caliber Dance Company. This credit card will be charged (but not without first contacting the cardholder) in the event that tuition is late in future months. There is a returned (nonsufficient funds or NSF check fee of $35.00. After 2 returned checks, money/payments will only be accepted in the form of cash, cashier’s check, money order, credit card and/or debit card. Students will not be permitted to dance in competitions or recitals if all fees, costs, tuition and costume balances are not paid in full by the time of the performance.

I hereby irrevocably consent to and authorize the use or reproduction by Caliber Dance Company of any and all photographs, recordings, videotapes and or other reproduction likenesses of the student's person or characteristics (reproductions) which have been secured by or for Caliber Dance Company for any purpose without compensation to the student/parent. All reproductions shall constitute the property of Caliber Dance Company, solely and completely. Further, I assign and release all rights to said reproductions and authorize Caliber Dance Company, or others authorized by it, to exhibit, broadcast, and /or distribute or otherwise further reproduce for said newspapers, close circuit television, web site, film, cable, and television, with or without compensation in perpetuity. I also release, discharge, and agree to hold harmless the producers or any persons, or entities acting under their permission or authority from any liability arising from the use of said reproductions.
