Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Blooming Einsteins has put in place preventative measures to reduce the spread of COVID-19; however, Blooming Einsteins cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Blooming Einsteins and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Blooming Einsteins may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Blooming Einsteins employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at the Blooming Einsteins or participation in Blooming Einsteins programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Blooming Einsteins, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Blooming Einsteins, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Blooming Einsteins program
I also agree to inform Blooming Einsteins if my child or anyone we are in contact with currently has been confirmed with Covid-19 or has been exposed to Covid-19. I also agree to inform Blooming Einsteins of any symptoms, fever, out of the country travel (past 90 days) or health concerns related to Covid-19.
COVID-19 - Exposure
Following Exposure or Symptoms
A student or staff member that thinks/knows that they have COVID-19 can return to school if they meet ALL of the following criteria: • It has been 10 calendar days since symptoms began • No fever (without fever reducing medicine) or other symptoms for 3 calendar days.
A student or staff member that tests positive for COVID-19, but does not have any of the symptoms, can return to school if they meet ALL of the following criteria: • It has been 10 calendar days since the positive test result • Has continued to have no symptoms •
A student or staff member exhibiting symptoms (not exposed) may return to school with negative test results or a doctor's note stating that a medical evaluation determined that their symptoms were due to another cause. The student must still abide by all health regulations for the cause of the symptoms.
A student or staff member that is showing symptoms but refuses a COVID-19 test may return to school if they meet ALL of the following criteria: • It has been 10 calendar days since symptoms began • No fever (without fever reducing medicine) or other symptoms for 3 calendar days.
A student/staff member that has been exposed (within six feet for more than 10 minutes without a mask) to another person (family, friend, other student) that has tested positive with COVID-19 must follow the criteria below: • Quarantine for 14 calendar days after the last exposure • Monitor symptoms of COVID-19 • If exhibiting symptoms or tests positive, then a student or staff member must follow those guidelines to return to school.
Guidelines For Exposure In School (Based on SCDHEC Guidelines)
Student/Staff who is sick will remain home for 10 calendar days from first sign of symptoms and must be without fever (without fever reducing medicine) or other symptoms for three calendar days. • Staff will monitor remaining students' daily temperature and symptoms for two weeks and follow above protocols as needed. Administration will work with local health officials to determine exposure risk to other students/staff and take additional steps as needed.
Agreement
Agreement and Acknowledgement: I have read the information provided in the Parent Handbook located on www.bloomingeinsteins.com . I understand and I agree to follow all policies and procedures of Blooming Einsteins outlined in the Parent Handbook.
Release
I acknowledge that I have voluntarily chosen to register the minors listed on this registration form to participate in activities including field trips, vehicle/foot travel, outdoor/indoor play, outdoor/indoor activities, bounce house use and have full knowledge of the risks that these activities present, including travel to, participation in, and returning from the activity. I understand that by being permitted to participate in activities, in lieu of gross negligence by Blooming Einsteins, I agree to assume any and all risk of injury or death. I further understand and agree to assume responsibility for all risk of theft, loss or damage of personal property which occurs at any time. I understand and agree that I have carefully read this agreement and fully understand all of its terms and conditions. I understand that this is a release of liability which could legally prevent me from filing suit or making any other claim for damages. By acknowledging and agreeing to this waiver, I am entering into this agreement freely and voluntarily.

I give permission to have my child appear in any Blooming Einsteins coverage, including social media or brochures.
Behavior Policy
Behavior Policy Students will be required to abide by the Blooming Einsteins policies, and procedures, to ensure that each participant remains safe. We are a non-corporal punishment facility. In most cases when discipline is needed, we believe in redirection, or diversion. If the previous measures become ineffective, we will notify parents. If poor behavior continues, a conference with parents will be held to discuss the behavior, and positive methods, to promote more appropriate behavior at our school. If behavior does not improve, as a last resort, the student may be removed from the program. Fighting, of any kind, will not be tolerated, and may result in suspension. This may include intentional hitting, punching, kicking, biting, swearing, or bullying. Gossiping about students, and/or their families, is also prohibited, and may result in suspension. We can assure you that safety, of all of our students, physically, emotionally, and socially, is our primary goal.
Withdrawal/Cancellation Policy
Early Withdrawal / Cancellation Policy A two-week notice of withdrawal in writing is required for all programs. Failure to provide a withdrawal notice will result in your account being charged for the tuition of the registered week(s). Blooming Einsteins reserves the rights to discharge any child/family for failure to pay tuition or for unmanageable and disruptive behavior that brings harm or continued disruption to the staff and other children.
Transportation Policy
Transportation to/from school and/or field trips to various destinations around the North/South Carolina are will be arranged by Blooming Einsteins. I give my child permission to participate in all Blooming Einsteins programs that require transportation noting that transportation will be in the form of a school activity bus, van, foot or other transportation measures.
Insurance Policy
Insurance coverage is a requirement to participate in any Blooming Einsteins Program. I, the undersigned, Parent or Legal Guardian of the registered participant, certify that the named participant is covered by an insurance program which will compensate for injuries incurred while participating in Blooming Einsteins activities.
Participation Policy
Agreement of Participation: I verify that my child is in good mental and physical health, and may participate in the Blooming Einsteins Program. I also verify that my child's immunization shots are up to date. I also agree to inform Blooming Einsteins of any medical conditions or medications that my child is currently taking. I give permission to authorize emergency care to my child in the event that neither the first or second guardians can be contacted.
Deposit Fees/Enrollemnt
A non refundable new family registration fee of $100.00 will be drafted after registration for new families registering in the After School or Virtual Hub program. This fee is per family and not per student and will be valid for life unless you withdraw from the program.
Summer Camp Deposit fee is $ 35.00 per week
After School Deposit fee is $93.00 and will be applied towards the first tuition payment. Minimum of 3 students needed per school for pick up.
The Deposit Fee will be drafted immediately to hold your child's spot. These fees are non refundable.
Payment Policy
Payment may be made in the form of cash, check or ACH draft.
Decline Fee of $25.00 for all returned payments.
