Payment Policy
By registering online you are automatically signed up for e-payment and you are authorizing Nicker's Retreat LLC, to use the account information for all of you account billing. Including but not limited to registration fees, tuition fees, competition fees, board fees and late charges.
By checking below you agree to take full responsibility for payment of all charges and understand that a $25 late fee may be applied to your account if your credit card/bank account is declined and cannot be processed for the amount due at that time.
Tuition is posted on the 25th of the month. Payment is due on the 1st of the month, no later then the 7th of the month and can be paid via cash, debit/credit card or check. On the 8th of the month account balances will be charged to the account information on file. Tuition is NOT pro-rated for ineligible absences.
Lesson Policy
Nicker's Retreat, LLC offers group lessons that are structured around the individual needs of each student and address personal levels, experiences, and goals. Our lessons are enjoyable, cover the skills to master control and keep the student and horse safe. Lessons are reserved in terms dependent of season. Each term is specifically designed to give student an education that encompasses all skills needed to progress to the next level. By clicking below you agree to attend the entire term.
• Minimum rider age is 4 years old.
• NO personal pets of any kind are allowed on the farm.
• Students age 4-12 are required to have an adult present at all lessons, mounted or unmounted.
• Students are always expected to exercise safety in the barn and while riding. Running, yelling or aggressive behavior is NOT allowed on the farm. Parents please be sure to monitor you child's behavior. Keep your child within eyesight so that we can all remain safe.
• Arrival time is 10 minutes before the start of each lesson to allow for grooming and tacking.
Students arriving late may be asked to observe the class with the instructor and will not be
eligible for a make-up lesson.
• Group lessons will start at the scheduled time. Lessons will end at the designated time regardless of student's arrival with no exceptions.
• Students should allot additional time at the end of each lesson to un-tack, return any tack/supplies to their proper places and groom their horse before leaving. A clean and tidy stall and aisle is expected. Students are responsible to properly remove waste left by their horse.
• Instructors reserve the right to hold a ground lesson or theory workshop when deemed
necessary or appropriate for any lesson. This includes inclement weather and/or student/horse distress
• Required attire: Long pants (must reach ankles), shirt (length to reach waistband), close toed shoes/boots with a hard sole and small heel (not to exceed 1.5 inches) and an approved helmet. (can borrow one of ours)

Release of Liability
In exchange for participation in the activity of horseback riding organized by Nicker's Retreat, LLC of 1730 Bayside Beach Road, Pasadena, Maryland, 21122 and/or use of the property, facilities and services of Nicker's Retreat, LLC, agree for myself, and (if applicable) for the members of my family, to the following:
1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Nicker's Retreat, LLC or the employees, representatives or agents of Nicker's Retreat, LLC.
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Nicker's Retreat, LLC for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Nicker's Retreat, LLC, whether caused by the fault of myself, my family, Nicker's Retreat, LLC . or other third parties.
3. INDEMNIFICATION. I agree to indemnify and defend Nicker's Retreat, LLC against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Nicker's Retreat, LLC .
4. FEES. I agree to pay for all damages to the facilities of Nicker's Retreat, LLC caused by any negligent, reckless, or willful actions by me or my family.
5. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Maryland law.
6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Nicker's Retreat, LLC has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.
7. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.
8. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
9. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.

Lesson Procedures
• Parking is located behind the garage through the automatic gate. Please use the keypad for entry. The gate closes automatically. (The gate is to keep horses in not cars out!)
• Arrival time is 10 minutes before the start of each lesson to allow for grooming and tacking.
Students arriving late may be asked to observe the class with the instructor and will not be
eligible for a make-up lesson.
• Students are responsible for neatly returning any tack/supplies to their proper places at the end
of each lesson. A clean and tidy stall and aisle is expected. Students are responsible to properly remove waste left by their horse.
• Students are required to wear appropriate attire including a helmet. Helmets are available for
use and students are required to sanitize them after each lesson.
Cancellation and Make-Up Policy
In the event that Nicker's Retreat, LLC must cancel a lesson, a make-up lesson will be offered at a later date. Lessons missed without 24-hour prior notice will not be re-scheduled; students will be charged the full amount of the lesson. Nicker's Retreat, LLC will make every attempt to reschedule during the current term. Cancellation/make-up exceptions may be granted in he case of a medical illness/doctor's note or other extenuating circumstances.
To qualify for a make-up lesson, Nicker's Retreat must be notified at least 24 hours in advance of scheduled absence and the student account must be current.
• Students are permitted one make-up lesson per term, which may be made up within thirty (30) days.
• Make-up lessons are subject to availability and approval.
• Make-up lessons are not guaranteed and are non-refundable.
• In the event that a student is unable to attend their make-up lesson, the lesson is forfeited and is ineligible for rescheduling.
• Make-up lessons do not carry over to the next term, with the exception of a proper cancellation within the last week of the term or in the event of an emergency situation, at which point the student will have thirty (30) days to reschedule. We are happy to discuss individual circumstances at any time but reserve the right to enforce our policies.
Withdrawal Policy
To withdraw a student from any class, camp or event, you must notify Nicker's Retreat, LLC in written notice and are responsible for tuition and any other fees during that time frame. Failure to attend class does not constitute a withdrawal. All deposits are non-refundable.
Authorization for Medical Treatment
I authorize Nicker's Retreat, LLC to obtain emergency medical treatment in the event of an injury.
Photo Release
The undersigned hereby grants Nicker's Retreat, LLC permission to take or have taken still or moving
photographs of myself/daughter/son.
The undersigned also authorizes Nicker's Retreat, LLC to use such photographs in its advertising, news
media, brochures, pamphlets, social media, website, and instructional material.
