COVID-19
I, the undersigned parent or legal guardian of a minor child, being aware of the minor's health and physical condition and having knowledge of the minor child's proposed participation in dance activities ("Activity") to occur with JULINE SCHOOL OF DANCE, INC., a California corporation ("JSD") at JSD's facility located at 1700 McHenry Avenue, Suite 50A, Modesto, California ("Facility"), hereby knowingly and voluntarily agree to the following with regard to the COVID-19 pandemic and government imposed quarantine. I understand that JSD will undertake "Protective Measures" during the quarantine as directed by Stanislaus County Public Health Services, including, but not necessarily limited to, as indicated below. JSD reserves the right to delete Protective Measures or add more stringent Protective Measures, as required by applicable law or government authority.
1. There will be separate entrance and exit doorways;
2. Hand sanitizers will be placed at every doorway and in lobby area;
3. Barres will be clearly marked to allow for 7 feet of physical distancing;
4. Barres and bathrooms will be cleaned several times a day, always between classes;
5. No parents and/or siblings allowed in the studio, dancers only;
6. Masks are optional while participating in the Activity, but may be mandatory while otherwise in the Facility;
7. All correction during class will be hands-off, no physical contact;
8. HVAC systems will be cleaned regularly, and new filters added;
9. Class sizes will be smaller than normal to facilitate physical distancing;
10. Staggered class times to allow for fewer people in common areas;
11. Drop off and pick up must be specifically at beginning and ending of classes to avoid waiting at the Facility;
12. Anyone with a fever, feeling unwell, or who has been exposed to COVID-19 are expected to self-report and stay home.
Notwithstanding the Protective Measures and other reasonable precautions taken by JSD, there remains potential and unavoidable risks with engaging in the Activity during the pendency of the COVID-19 pandemic, including, but not necessarily limited to, that the minor child could contract the COVID-19 virus which could lead to illness, hospitalization, lasting health difficulties, and/or death of the minor child, me, my family members, or anyone with whom the minor child is near if the minor child becomes infected with the COVID-19 virus. By executing this Waiver, I acknowledge and agree that I understand these potential and unavoidable risks and that I still desire the minor child to engage in the Activity at the Facility despite these risks.
After having read and with full understanding of the information stated herein above, on behalf of the minor child, myself, and my heirs, executors, administrators, assigns, and/or personal representatives, I hereby knowingly and voluntarily enter into this Waiver and Release of Liability ("Waiver"), and hereby knowingly and voluntarily waive any and all rights, claims, or causes of action of any kind whatsoever arising out of or relating to the Activity while at the Facility, and I hereby release and forever discharge JSD and its shareholders, directors, officers, employees, representatives, participants, agents, staff, and volunteers, and their respective heirs, predecessors, successors, and assigns (collectively "Released Parties") from any and all present and future liability arising out of or in connection with engaging in the Activity at the Facility. For the purposes of this Waiver, liability means any and all claims, damages, demands, losses, causes of action, lawsuits, liabilities, or judgments of any and every kind that occurs during or incidental to the Activity, that result from any cause, whether caused by the negligence of Released Parties or otherwise, including, but not limited to any physical or psychological injury, illness, paralysis, death, damages, and/or economical or emotional loss, that may be suffered as a result of engaging in the Activity at the Facility.
By executing this Waiver, I agree to indemnify, defend, and hold Released Parties harmless from and against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees, expert witness fees and any related costs. If litigation arises pursuant to any claims made by me or by anyone else acting on my behalf, or if JSD or the Released Parties incur any of these types of expenses, I agree to immediately reimburse Released Parties in full.
By executing this Waiver, I confirm that I understand that the release contained herein shall apply to all known or unknown, foreseeable or unforeseeable, anticipated and/or unanticipated claims and injuries which in any way relate to, are connected with, or arise out of the Activity or the matters described herein, and expressly waive the provisions of Section 1542 of the California Civil Code, which reads as follows: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
This Waiver shall not extend to any rights which may not be waived under California law.
In the event that any provision contained within this Waiver shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this Waiver shall be determined to be unlawful or otherwise unenforceable, the remainder of this Waiver shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties in executing this Waiver.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND EVERY PORTION OF THIS WAIVER AND THAT THIS WAIVER CONSTITUTES A LEGALLY BINDING AGREEMENT UNDER WHICH I HAVE AGREED TO A RELEASE OF LIABILITY. BY AGREEING ONLINE, I HEREBY AGREE THAT THIS WAIVER IS INTENDED TO BE AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE STATE OF CALIFORNIA. I FULLY UNDERSTAND THAT UNDER THIS WAIVER I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT. BY AGREEING, I CONFIRM THAT I HAVE AGREED TO IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT OF ANY KIND OR GUARANTEE BEING MADE. I UNDERSTAND THAT THE MINOR CHILD WOULD NOT BE PERMITTED BY JSD TO ENGAGE IN THE ACTIVITY WITHOUT ME AGREEING TO THIS WAIVER. I INTEND BY MY AGREEMENT FOR THIS TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ANY AND ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
Policies & Procedures
REGISTRATION: An annual $30 registration fee is due at the time of registration along with the first month's tuition. The registration fee is non-refundable. If a student drops class or takes a leave of absence, a new registration fee of $30 will be paid upon returning, and their spot in class cannot be held.
TUITION: Tuition is an annual fee. For your convenience we have divided the yearly tuition into 10 equal monthly payments from Aug - May. The monthly tuition rate remains the same regardless of the number of actual classes in any given month. This will vary due to holidays, extra weeks in a month, etc. No tuition is due in June. Invoices will be emailed on the 1st & 15th of each month (only if you have a balance owed.) If there is still a balance due by the 15th, the credit card on file will be processed for payment on the 15th of each month.
CLASS PLACEMENT: To stay in line with the public school system, Sep 1 (born on or before) is the cutoff birthdate used for class placement.
FEES/DISCOUNTS: Tuition is due on the 1st of every month. If there is still a balance due by the 15th, the credit card on file will be processed for payment on the 15th of each month. If there is still an amount due after credit cards are processed, a $10 late fee will be assessed on the 15th. A $25 fee will be charged for any returned or stopped payment check. A $4 processing fee will be charged for all phone payments. A $5 discount will be given to each student (per month) when 3 or more students are dancing in the same family.
COSTUMES: Recital fees are due the 3rd Saturday in January and a $10 late fee will be assessed on Feb 15th. If you are not dancing in the recital, we must be notified in writing BEFORE the 3rd Saturday in January, otherwise a costume will be ordered and you will be responsible for the recital fee.
OVERDUE ACCOUNTS: Students will not be able to register for new classes, participate in the recital, or participate in any field trips until account balances from ALL family members are paid in full.
DROPPING CLASS: Written notice is required to discontinue class. You may drop off a note to the front desk or email admin@julineschoolofdance.com. You may not attend make-up classes after you drop.
MAKE-UP CLASSES: Students who miss class due to illness, vacation or other activities, may take a make-up class at no charge in the same class or one level below. Simply inform the teacher you are taking a make-up class; there is no need to inform the front desk. Tuition will not be refunded for missed classes. Only current students may take make-up classes.
ONLINE CLASSES: In the event that in-studio classes are cancelled, classes will continue via ZOOM. The content of any videos, emails or communication with your dancer is confidential and intended for the recipient specified in the message only. It is strictly forbidden to share any part with any third party, without a written consent of JSD. All video links and files are not to be shared publicly or privately with any other people. They are for your dancer alone.
HOLIDAYS: No classes will be held on: Labor Day, Veterans Day, Thanksgiving (Thurs - Sat), Christmas Break, Martin Luther King Day, Presidents Day, Easter Break and Memorial Day. If your class falls on a Holiday (other than Christmas and Easter Break) you may take a free make-up class. No make-ups will be available for Christmas and Easter Break as there are no other classes being held during those weeks.
PARKING: Out of safety for our dancers, there is a NO PARKING ZONE immediately in front of the studio. Please DO NOT drop off or pick up your dancer here, as other dancers exiting the studio may not be seen by passing cars. You will be asked to move if you are parked in the NO PARKING ZONE.
PICKUP POLICY: All minor students are to be picked up immediately by the Parent/Guardian at the conclusion of class. If a student is not picked up after 10 minutes you will be charged $1 per 1 minute period. Juline • School of Dance, Inc. holds no responsibility for students left unattended for periods of time before or after lessons/classes.
VIDEO CAMERAS: Out of safety for our dancers, there are multiple video cameras installed throughout the hallways. There is no audio on the cameras.
