Legal Waivers
***LIABILITY WAIVER: I, the undersigned, as the parent or legal guardian of the child(ren) listed on this application in consideration of the request and permission of my son(s)/daughter(s) to participate in Catch the Wave Swim Club programs, including, but not limited to Swim Lessons and Parties, Parent's Night Out and Camps, hereby assume full responsibility for all risks or injury or loss which may result from my son's/daughter's participation in these activities and hereby agree to hold harmless, release and forever discharge Catch the Wave Swim Club, it's officers, agents and employees from and waive any and all claims and demands whatsoever which the undersigned and any of them or any third person of any accident, illness injury or death of any person and persons, or damage to or loss or destruction of any property arising or resulting directly or indirectly from my son's/daughter's participation in the aforementioned program and occurring during said participation or any time subsequent thereto, save and except that the above provisions shall not be applicable to injury to or death of persons, or damage to or loss of property arising out of the sole negligent acts or omissions of Catch the Wave Swim Club, their officers, agents, affiliates or employees. The terms of this release shall serve as a release and assumption of risk for my son(s)/daughter(s), heirs, executors and administrators and for all my family members. I understand that there are risks inherent in activities conducted by Catch the Wave Swim Club including, but not limited to, paralyzing injuries, brain injuries, and death. With the full understanding of the facts, I state, that to the best of my knowledge, my son(s)/daughter(s) listed on this application has no medical, physical, mental or emotional health conditions which would hinder or prevent his/her active participation in Catch The Wave Swim Club programs.***
***CONSENT FOR EMERGENCY MEDICAL TREATMENT: In the event of a medical emergency, the undersigned Parent(s)/Guardian(s) of the above named participant(s), hereby grants authorization to Catch the Wave Swim Club and its representatives to employ any legally licensed physician or health care facility on behalf of each of the undersigned, and to direct and/or order emergency medical treatment for the above named participant(s). Each of the undersigned further agrees that neither Catch the Wave Swim Club, nor any of its representatives shall be liable under any circumstances to anyone for exercising the foregoing authority in the event of an emergency.***
***COVID-19 WAIVER: I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that Catch the Wave Swim Club Inc, has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that Catch the Wave Swim Club Inc can not guarantee that I, or the minor parties for which I am responsible, will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, pool staff, and other swimming pool customers and their families. I voluntarily seek services provided by Catch the Wave Swim Club Inc. and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment. I attest on behalf of myself & children that: (1). I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. (2). I have not traveled internationally within the last 14 days. (3). I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. (4). I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities. (6). I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.***
Program Policies
***REQUIRED SWIM WEAR: (1). Swim Diapers - are required for any student who is not yet toilet trained. The Department of Public Health requires children to wear a non-disposable (re-usable, tight-fitting) swim diaper over a disposable swim diaper for the health and safety of each child in the water. It is recommended that you check with your Catch The Wave location prior to your first class to ensure the appropriate size is in stock and available for purchase. (2). Swim Caps - It is required that swim caps be worn by every swimmer with the exception of Parent/Child (baby) students. These are color coordinated by level with names and start dates written on each cap to allow our team get to know your child better and to help track their progress. They are purchased at the front desk and as your child moves up to the next level you will need to purchase the next color cap.***
***CLASS CONSOLIDATION: Due to our small class sizes, occasionally some of our classes will need to be moved or combined with others depending on our enrollment level. In the event you are unable to move, your class time will still be honored until the end of the month but your child may be placed in a higher or lower level class during that time. While we try to keep class consolidation to an absolute minimum, sometimes due to absences, students leveling up and other circumstances, it can happen.***
***POOL CLOSINGS: In the event we must cancel lessons or shut down the pool due to bad weather, pool accidents, pump malfunctions, etc., you will be issued a free makeup on our behalf. We do not issue refunds for lessons missed due to these circumstances. During the holidays, we are closed on Halloween (night classes only), Thanksgiving, Christmas Eve, Christmas Day, New Year's Eve, New Year's Day. If enrolled on these days, your child/children will automatically be marked absent and a free makeup will be given.***
***INSTRUCTOR SUBSTITUTION: Sometimes instructors are sick, go on vacation or have personal issues they need to attend to. Due to these unforeseen circumstances, we cannot guarantee your instructor of choice. However, we will do our very best to accommodate your child the best we can.***
***MAKEUP POLICY: We have a Lesson Guarantee policy. There is no time limit for when makeups need to be scheduled and they never expire once on the account. In order to qualify for a makeup lesson the absence must be reported beforehand. Students have to be enrolled in an active class in order to schedule makeups and they can only be scheduled one week out. For private lessons, a $20 rescheduling fee is charged for missed lessons due to the unique and personalized scheduling of instructors. Rescheduling fees are NOT charged if your child has medical issues, scheduled surgeries, etc (proof of a doctor visit must be provided). We offer free makeups for the following: 1. When absences and makeups are recorded and booked through the Parent Portal. 2. When absences are recorded 24 hours in advance. A small $3 rescheduling fee will apply per student for the following: 1. When absences are reported less than 24 hours prior to the start of the class. 2. When reception records an absence or schedules as makeup instead of utilizing the Parent Portal.***
***CANCELLATION POLICY: We make it a point to meet the needs of our customers through flexible scheduling options, instructor requests, proper class ratios, etc. The drop policy outlined below ensures that we are able to do just that with the use of proper planning. Two requirements must be met in order for members to discontinue lessons: (1). A MINIMUM of 30 days' notice. (2). Final lessons must occur during the last week of the month. If you are unable to meet these requirements, we offer the following options: (1). We can hold next month's tuition as a future credit on your account available for you to use upon returning. (2). You can opt to pay a $36 early cancellation fee per child (equivalent to two classes). This option is only available if next month's tuition has not already been billed. NO REFUNDS WILL BE GIVEN. 30-DAY GRACE PERIOD (dates are for any given month): 1st - 3rd: No cancellation fee. 4th - 5th: 60% of fee . 6th - 7th: 80% of fee. 8th+: 100% of fee.***
***CALL & SMS COMPLIANCE: Catch The Wave uses texting and voice calling as convenient and fast methods of communicating with our members. I agree to receive automated text messages and calls from Catch The Wave Swim Club to the mobile number that I have provided. I understand that I am not required to provide my consent as a condition of purchasing any goods or services through these methods. I can Reply STOP to cancel. I understand that regular message and data rates may apply.***
***MEDIA RELEASE: I understand that photos/videos are occasionally taken at Catch The Wave Swim Club and any photo taken of my child(ren) may be used for training and publicity purposes, including print, digital and all other forms of media advertising. Not all photos/videos are posted or published and in the event a parent or guardian is unhappy with published photo/video, it will be taken down promptly upon request.***
Statements & Billing
***Tuition at Catch the Wave Swim Club is billed monthly and is done in advance on the 21st of each month. Account balances for extra charges (outside of tuition) are charged to the card on file throughout the month as needed.***
***ANNUAL FACILITY FEE: We charge an annual facility fee of $36. This rate is billed yearly in March and then prorated throughout the year depending on the month you enroll or re-enroll. This fee is charged per family (not per child) and is used for the purpose of online software & facility maintenance.***
***PAST DUE ACCOUNTS: Credit cards are required to be on file, and credit card information can be updated at anytime via the Parent Portal. A $10 fee will be charged if your tuition payment is late or if the card on file gets declined. The fee will be removed if payment information is updated within two days. If we are unable to get a hold of you or receive a payment by the 1st of the next month, your child will be dis-enrolled from the program, automatically charged an early cancellation fee, and your account will be moved to "delinquent" status to be sent to a third party collection agency.***
***PRICING: Standard lessons: $18/lesson. Waves Ahead Membership Packages: $1500, $1000, $500. Drop-in classes: $23/lesson. Private classes: $72/lesson. Private lessons (x12) paid upfront: $54/lesson. All lessons/packages are paid in advance and non-refundable. No refunds will be issued for unused classes.***
***AGREEMENT: I understand and formally give consent/authorize Catch The Wave Swim Club, Inc. to automatically bill my card in accordance with the pricing/policies stated above. I fully understand the cancellation policy, fees, and the regular monthly amount my that card will be charged for lessons. I understand that my card will continue to be charged until I notify Catch The Wave Swim Club in writing.***
Electronic Signature Agreement
***AGREEMENT: I agree that this document may be electronically signed. I agree that electronic signatures appearing on this agreement are the same as handwritten signatures for the purpose of validity, enforceability, and admissibility.***
