WARRANTY AND CONSENT OF PARENT/GUARDIAN
ASSUMPTION OF RISK
RELEASE AND WAIVER OF LIABILITY
INDEMNITY AGREEMENT
IN CONSIDERATION of allowing my minor child/ward to participate in the program, related events and activities of the Newmarket Ninja Academy and Pulsars Gymnastics Club.
I WARRANT TO YOU THAT:
1. I am a parent/guardian having full legal responsibility for decisions regarding my minor child/ward, and
2. I am familiar with the risk of serious injury and death which any participant in this program must assume, and
3. I believe that my minor child/ward is physically, emotionally and mentally able to participate in this program, and that his/her equipment is mechanically fit for his/ her use in this program, and
4. I understand, and will instruct my minor child/ward, that all applicable rules for participation must be followed and that at all times the sole responsibility for personal safety remains with my minor child/ward, and
5. I will immediately remove my minor child/ward from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that my minor child/ward has experienced any deterioration in his/her physical, emotional or mental fitness for continued participation in the program.
I UNDERSTAND AND AGREE, ON BEHALF OF MY MINOR CHILD/WARD, MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:
1. an unqualified ASSUMPTION OF ALL RISKS associated with participation in this program by my minor child/ward even if arising from negligence, or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of the program organizer and any persons associated therewith or participating therein, and
2. a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of the program organizer and all persons and organizations associated with it and the program including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/ or lessors of the premises used to conduct the program, sanctioning bodies, medical or rescue personnel (the RELEASES), of and from with the respect to all injury, disability, death or loss or damage to person or property whether arising from the negligence, or negligent rescue of or by the foregoing or otherwise, and
3. an UNDERSTANDING NOT TO SUE the RELEASES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from the participation of my minor child/ward in the program, and
4. an AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASES, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the RELEASES or otherwise.
I HAVE READ THIS DOCUMENT THOROUGHLY.
I UNDERSTAND THAT THE RELEASES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY MINOR CHILD'S/WARD'S PARTICIPATION IN THIS PROGRAM.
I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I GIVE UP SUBSTANTIAL LEGAL RIGHTS I AND/ OR MY MINOR CHILD/WARD WOULD OTHERWISE HAVE.
I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.
Payment Policies
Annual Registration Fee
With the exception of birthday parties, I understand that there will be a $35.00 annual registration fee due each year from July 1st to June 30. This fee is the same regardless of whether I register in one or several programs during that year.
Billing Authorization
I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (Electronic Fund Transfer (EFT) Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my EFT draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
Payment Information
Tuition is charged on the 1st of the month and is due by the fifteenth of each month. There is a $15 late fee for payments not received by the 15th of the month. There is a $10.00 declined credit card charge for any credit card that is declined for any reason. I understand that I must inform the instructor in person or by email if I wish to terminate membership before the first of the month. After this date I will be responsible for payment for the month of termination.
Drop Procedure
Parents must either inform an instructor in person or by email (preferably both) or cancel online to drop from a class. Notice must be given before the 1st of the upcoming month.
Please note: You are responsible for payment for your student's classes whether or not your student attends class until the time you notify the staff. Written notice must be given 30 days before the 1st of the following month. Please do not rely on your student to verbally let us know that he/she will no longer be attending classes. If a student stops coming to class without notification then that student's account will be charged for the additional 30 days. This charge will be for holding the student's place in that class instead of offering that place to one of the many on a waiting list.
General Policies and Procedues
Skill Tracking Software
By registering with us you understand that your email will be used by Newmarket Ninja Academy and jackrabbitclass.com. All our classes are now tracked electronically and you are able to view their progress at any time through your own private parent portal. You will receive regular updates on skill improvement and Certificates showing that your child has moved up a level. If you do not wish to have your child's progress available you can let us know and we will remove your email. Removing your email though will prevent you from receiving newsletters, notices, updates and reminders from Newmarket Ninja Academy. It will not remove contact from us regarding your account.
Make-up Policy
Make-up classes are possible after a class has been missed, providing that there is a suitable space available. We are not able to promise that an appropriate class will be available. Make-up classes must be booked either online or through an instructor at least 24 hours before the class begins.
What to Wear
Students are required to wear a black t-shirt and black shorts to classes. NO chewing gum or dangling jewelry. Hair should be pulled neatly and securely away from the face so that is stays up for the entire workout. Students should not wear bows or other large hair ornaments that may cause discomfort during activity. Jewelry should not be worn during classes. PLEASE LEAVE JEWELRY ARTICLES AT HOME. This facility and staff will not be responsible for ANY items that may be lost or stolen. Be sure your student's personal items are marked with their name.
Drop-off and Pick-up
Be sure your student arrives 5-10 minutes before (no earlier please) their scheduled class time. Please pick up your student on time. Please inform us if you know you will be late picking up your student. Instruct your student to wait inside the building and you should escort them from the building to your car. During peak times the parking lot is crowded. Please take into consideration that our students may include young children. Please drive slowly and carefully. Do not take a chance on your student running to and from your car.
Email Consent
By providing my email address I am giving permission to receive emails from Newmarket Ninja Academy, Pulsars Gymnastics Club, and jackrabbitclass.com. I understand that I can unsubscribe at any time by logging into the Parent Portal, clicking unsubscribe on one of our emails or calling our front desk.
Photography
Newmarket Ninja Academy and Pulsars Gymnastics Club may from time to time take photographs and/or videos of the children in the gym. These photos may be used for promotional materials including our website with no remuneration for the member.
