Release of Liability Policies
As the legal parent or guardian, I hereby give my consent for my child(ren) and/or myself to participate in any and all dance and activities/events held at Bailey Fine Arts or attended by Bailey Fine Arts. I understand that by the nature of these activities/events, they carry a risk of physical injury that can not be eliminated. I release and hold harmless Bailey Fine Arts, its owners, operators, agents, contractors, and volunteers from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, disability or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon the premises or en route to or from any of said premises. I understand that sometimes appropriate physical contact is required during the instruction of dance, acro, and tumbling and I give permission for instructors to make appropriate physical contact with me or my child for such instruction.
Covid-19 Info
General Guidelines That Apply to All-
All employers have to determine how best to minimize the spread of COVID-19 in the workplace. In order to re-open and successfully remain open for business, everyone individually and collectively must actively participate in the core recommendations:
We will have touchless infrared thermometers available, and will be taking the temperature of all individuals prior to entering the building. For the screening, please have dancers wear a face covering. Social distancing and masks are required of all dancers and staff in common areas of the studio (lobby, bathroom, hallways, lounges, changing shoes/prepping for class, etc.).
Dancers are welcome to wear a mask during class participation, if they feel more comfortable.
As a parent or guardian, I agree that I will not send my child to Bailey Fine Arts if any of the following are true:
1. My child has experienced any new or worsening flu-like symptoms, such as fever (100.4 F or greater), cough, shortness of breath, etc.
2. My child has been in close contact with someone under evaluation for COVID-19 infection or with someone who has a confirmed infection of COVID-19. I understand that COVID-19 close contact exposure is defined by the CDC as contact with someone at a distance of less than 6 feet for a period of time greater than or equal to 15 minutes.
***Anyone who feels like they have been exposed to COVID-19, please refer to the SCDHEC.gov website for guidance.***
1. Self-isolation - if you are sick, stay home.
2. Practice social distancing of at least six feet distance to the greatest extent possible.
3. Wash hands frequently (20 seconds with soap and water or use of a sanitizer that contains at least 60% alcohol).
4. Clean and disinfect frequently touched objects (e.g. keyboards, phones) and surfaces (e.g. handrails, workstations, sinks) and remove unnecessary frequently touched surfaces.
5. Avoid touching of eyes, nose and mouth with unwashed hands.
6. Consider wearing a cloth face covering when it is difficult to practice social distancing (do not use on children under two years old, people with difficulty breathing, or people who cannot remove the mask themselves).
7. Strongly cover mouth and nose when you cough or sneeze, and throw used tissues away immediately after use.
8. Avoid using other employees' phones, desks, offices or other work tools and equipment when possible, or disinfect them before and after use.
9. Minimize the use of soft surfaces like cloth covered chairs or area rugs that are more difficult to clean or disinfect.
Student Info-
• Dancers and faculty inside the building only. Parents must wait outside and their child will be dismissed to them after class.
• All dancers must sanitize their hands upon entering the building and before they exit the building
• Classes will end 5-10 minutes before the next class to allow for cleaning between classes. Creative Movement classes have a 15 minute pad after each class, so there will be instruction for the full 30 minutes. A detailed outline of procedures when entering and exiting the building will be published prior to the first day of classes. Please be prompt in picking your dancer up to aid in this effort.
• No access to water fountain. Dancer must bring their own bottled water.
• One student at a time will be allowed to use the restroom (with teacher's permission). When possible, dancers should arrive at the studio already dressed for class. There will be limited use of restrooms for changing, at this time.
• All dancers items will be stored in a specific place while they are in the studio (distanced from other dancers' belongings) and this area will be disinfected after the dancer leaves. Each dancer will be allowed only one bag in the studio.
Covid-19 Waiver
COVID-19 ASSUMPTION OF THE RISK WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT ACKNOWLEDGEMENT
IN CONSIDERATION for being permitted to enter Bailey Fine Arts Centre (hereafter known as the studio) and return to class and/or for my children to enter and/or to participate for any purpose, including, but not limited to, observation or use of the studio or equipment, or participation in any on or off-site program affiliated with the studio. I acknowledge that (a) novel coronavirus ("COVID-19") infections have been confirmed throughout the United States, including South Carolina; (b) COVID-19 is extremely contagious, and is believed to be spread by various methods, including person-to-person contact and contact with contaminated surfaces; and (c) that it is believed that people who have COVID-19, but do not show symptoms, may be able to spread the virus as well.
AGREEMENT TO ABIDE BY STUDIO PROCEDURE/POLICIES - I hereby agree, represent, and warrant that neither I nor my children shall visit or utilize the studio services, and programs of the studio if I, he or she: (i) experiences symptoms of COVID-19, including without limitation, fever, cough, shortness of breath, chills, repeated shaking with chills, muscle pain, headache, sore throat or new loss of taste and/or smell (or any other symptoms later to be determined to be a symptom of COVID-19); (ii) has a suspected or diagnosed/confirmed case of COVID-19; or (iii) within the last 14 days has been exposed to someone who exhibits the symptoms listed in (i) above or has a diagnosis as set forth in (ii) above. I agree to notify the studio immediately if I believe that any of the foregoing access/use restrictions may apply. The studio has taken and may in the future take certain steps to slow the transmission of COVID- 19, including, without limitations, the access/use restrictions set forth above. I acknowledge and agree that the studio may revise its procedures at any time and further agree to review and to comply with the studio's revised procedures as a condition of entering and/or utilizing the studio, services, and programs of the studio. I further acknowledge and agree that due to the nature of the studio, services, and programs offered by the studio, social distancing of 6 feet per person may not always be possible. I understand that the risk of becoming exposed to or infected by COVID-19 at the studio may result from the actions, omissions, or negligence of myself and others, including, but not limited to, studio employees, volunteers, and program participants and their families. I fully understand and appreciate both the known and potential dangers of utilizing the studio, services, and programs of the studio and acknowledge that use thereof by me and/or my children is completely voluntary and may, despite reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.
IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER THE STUDIO FOR ANY PURPOSE, INCLUDING BUT NOT LIMITED TO, OBSERVATION OR USE OF STUDIO OR EQUIPMENT, OR PARTICIPATION IN ANY ON-SITE OR OFF-SITE PROGRAM AFFILIATED WITH THE STUDIO, I HEREBY AGREE TO THE FOLLOWING:
ASSUMPTION OF RISK AND RELEASE OF LIABILITY - I voluntarily assume all known and unknown risks of COVID-19 exposure and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, quarantine, personal injury, illness, disability, and/or death), damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with attending the studio or participating in studio programming (collectively, "Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the studio, its employees, agents, and representatives, of and from all Claims of every kind arising out of or relating to COVID-19. I understand and agree that this release includes all Claims based on actions, omissions, or negligence of the studio, its officers, directors, employees, agents, volunteers, and representatives (collectively, "Releasees"), whether a COVID-19 infection occurs before, during, or after participation in any studio program.
INDEMNIFICATION - I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS the studio and all other Releasees from any loss, liability, damages or costs arising from or related to COVID-19 exposure (including without limitation cost of defense and legal fees for counsel of such Releasee's choosing) which such Releasee may incur, whether caused by active or passive negligence, or otherwise while I or my child(ren) are in, upon, or about studio premises or present for or participating in any program affiliated with the studio, specifically including any loss, liability, damages or costs arising from or related to Claims, which may be asserted by my children or their representative. I understand and agree that the studio is not required to provide insurance to cover me or my children in the event they suffer COVID-19 related damage, quarantine, illness, injury, or death, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with the studio.
CONCLUSION AND AGREEMENT TO ALL TERMS - I expressly agree that the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of South Carolina and that if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.
I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS AGREEMENT. I AM NOT RELYING ON ANY REPRESENTATIONS, STATEMENTS OR INDUCEMENTS, WRITTEN, ORAL OR OTHERWISE, NOT SET FORTH IN THIS AGREEMENT. I AM AWARE THAT BY AGREEING TO THIS AGREEMENT I AM GIVING UP VALUABLE LEGAL RIGHTS, INCLUDING MY AND MY CHILDREN'S RIGHT TO RECOVER DAMAGES FROM THE STUDIO ARISING FROM OR RELATED TO EXPOSURE TO COVID-19 AND/OR ANY QUARANTINING REQUIREMENTS, ILLNESS, INJURY OR DEATH RESULTING THEREFROM. I UNDERSTAND THAT THIS DOCUMENT IS A PROMISE TO NOT SUE, A RELEASE, AND AN INDEMNIFICATION FOR ALL CLAIMS. I ALSO UNDERSTAND AND AGREE THAT THIS AGREEMENT IS MADE ON BEHALF OF MY MINOR CHILD(REN) AND/OR LEGAL WARDS AND I REPRESENT AND WARRANT TO THE STUDIO THAT I HAVE FULL AUTHORITY TO SIGN THIS AGREEMENT ON BEHALF OF SUCH MINOR(S).
Online Enrollment and Registration
By registering online I give permission to Bailey Fine Arts to process the credit card provided and agree that the credit card provided will be automatically charged for the registration fee(s) and 1/2 August tuition, and then monthly tuition each month thereafter, for selected classes. Any applicable discounts will be applied, including the Pre-Registration discount for those who completed that form in May 2020. I understand that my child/children are not registered or enrolled for classes until the online registration is complete and the credit card charge has processed. Registration should be completed soon to ensure placement in desired classes beginning August 17, 2020. Class availability is on a first come first serve basis. We reserve the right to cancel or reduce class time due to low enrollment.
Payment Policies
All fees are based on our nine and a half month schedule and are due the first class of each month. Tuition is the same each month, regardless of the number of weeks the class(s) is offered, in the month. There will be a $20.00 charge for payments received after the 10th of each month. Students are considered enrolled and responsible for tuition, unless 30-day written notification is received at the studio. Students with delinquent accounts will not be allowed to participate in class, until their account balance becomes current. All deposits for registration, costumes, t-shirts, etc. are non-refundable. Everyone enrolled in our auto draft program, will be charged their costume deposit in the November draft, their costume balance in the February draft and their Recital Fee in the March draft. There is a $25 fee for returned checks.
Monthly Autodraft
IMPORTANT: All Bailey Fine Arts accounts are automatically enrolled in our monthly auto-draft. All charges billed to your account each month, will be automatically charged to the credit card you provide in this registration. I understand that my credit card will continue to be charged on the first of each month, for all monthly charges incurred at Bailey Fine Arts, until all balances for the 2020-2021 dance year have been paid in full. There will be a 3.5% processing fee added to your account each month. Anyone wishing to avoid this fee may pay Cash, prior to the first of the month, when credit cards are automatically drafted. All families are required to keep a credit card on file with a sufficient open to buy amount, for all monthly charges, in order to remain enrolled in classes.
Recital Fees
Recital fees (not to be confused with recital costume fees) will be billed on February 1, 2021. There will be a recital fee of $35 for families with one participant or $40 for families with multiple participants. Recitals fees are due by the first class of March. If we are notified after February 28, 2021 that a dancer is no longer participating in recital, the recital fee is non-refundable.
Costume Fees
Recital costume deposits are billed in October ($50 per costume/per class), and are due by November 10, to avoid an additional processing fee of $20. The balance for all costumes is due on or before February 10, to avoid a late fee of $20. If a class is dropped after costumes are ordered, the remainder of the Costume Balance must still be paid in full. All auto-draft accounts will be drafted for these costume fees with their November and February draft. There will be no costume refunds for dropped classes or withdrawals from the studio after November 10th, 2020. I understand that it is my responsibility to inform Bailey Fine Arts no later than November 10, 2020 if my dancer will not participate in the end of year recital.
Advertising Release
I agree to give Bailey Fine Arts the unrestricted right and permission to use, publish, copyright and re-use any photos, videos or digital images taken of my child/children, for the purposes including but not limited to the promotion or advertising of Bailey Fine Arts, using any media it chooses (social media, newspapers, flyers, website, magazines, billboards, etc.).
Weather Related Closings
Weather Related Closing-In the event of Bailey Fine Arts needing to close for inclement weather, announcements are on the studio website, through the email list and our Facebook page. No make-up classes will be scheduled for weather closing, but you may make-up the lesson in a comparable class on another day. Make up classes must be used with-in the current dance year session, and must be scheduled prior to attending.
Time Between Classes
Time Between Classes-All students must be picked up from classes on time. Young students cannot be left unattended between classes. If I approve of my dancer being responsible for themselves during any schedule gaps or allowed to leave the studio, I understand I must fill out a waiver at the front desk.
Dress Code
Dress Code- Dress Code-Dancewear is required for ALL classes. There are no exceptions. Being dressed properly will enable the instructor to correct body placement. It also allows students to feel equally part of a group. The Dress code is as follows and will be enforced:
***Modesty: No midriffs should be shown at any time, and thighs should be covered. Leotards should be worn with tights. Students may elect to wear shorts over top of their leotard for some classes, but tights must still be worn underneath.
***Shoes: Proper shoes in specific colors are required for all classes. Please see shoe list below.
***Hair: Neatly secured away from face for all classes. Hair in a bun for all ballet technique, and pointe classes.
***Black Leotard for all classes, unless otherwise specified below. Pink tights for all ballet classes.
CREATIVE MOVEMENT - leotard (any color at this level) and tights, black tap shoes, pink ballet shoes
PRE-BALLET/BALLET 1 - leotard (any color at this level) and pink tights, pink ballet shoes
TAP 2/TAP 3 - leotard (any color at this level) and tights, black tap shoes
BALLET/POINTE-black leotard for all ballet classes (Ballet B and up), pink tights, hair in bun for all ballet classes (Ballet B and up), pink ballet shoes. Pointe shoes MUST be worn for all pointe classes.
TAP - black leotard (for all classes Tap B and up), black tap shoes
JAZZ - JAZZ A, B, AND C - tan jazz shoes
INT JAZZ AND UP - black jazz shoes
LYRICAL - pirouette style lyrical shoes/Apolla dance socks may be worn in class
CONTEMPORARY - barefoot/Apolla dance socks may be worn in class
Danceroom Rules
Danceroom Rules- No Food or Drink in the dance rooms. Only water bottles are allowed.
-It is very distracting to the teacher and other students when students come in and out of the room during classes. Dancers must remain in class during the whole session. A water bottle should be brought in to class.
-Dress Code must be followed in all dance classes.
-No cell phones in the dance rooms during class.
-No video recording on any device is permitted in class, without the instructor's permission. Posting video of classroom activities to social media by students or parents without the class instructor's permission, is prohibited.
-Anyone wishing to observe a class must ask for the instructor's permission, prior to the start of the class.
-We have a GREAT staff at BFA, and students are in class to learn from the teachers. All of our teachers spend countless hours preparing for classes, and have something valuable to teach each of their students. Dancers must be respectful to teachers and their peers, at ALL times. Disrespectful behavior will not be tolerated.
