Medical Treatment / Emergency
(a) Authorize(s) Aquatics Academy Inc. or a company/individual associated with Aquatics Academy Inc. ("Aquatics Academy"),
in the event of an emergency, to use its reasonable discretion, on behalf of the undersigned, the undersigned's child(ren) or associated spectator(s) participating in or attending at one or more of Aquatics Academy's current or future programs, in rendering first aid treatment and/or
arranging for emergency medical care (including hospitalization), at the expense of the undersigned;
Individual/Medical Needs
(b) Acknowledge(s) that if my child has an individual and/or medical need, will be disclosed on this registration form and submitted
before the session starts to ensure that Aquatics Academy and its staff are best equipped to meet the needs of such student;
Photography/Video
(c) Consent(s) to the use by Aquatics Academy of each student's likeness for publicity purposes;
(d) Acknowledge(s) for the safety and security off all parties, the use of security video equipment at the facility located at 2 Champagne Drive, Unit E1,E3. North York, Ontario M3J 0K2. ;
(e) Acknowledge(s) that camera(s) and video recording device(s) are strictly prohibited for use in any changeroom or washroom in any of our program locations or venues.
Deposit(s) / Fee(s)
(f) Acknowledge(s), that a non refundable deposit of $100.00 per participant/swimmer is required to reserve a spot in any program or service offered by Aquatics Academy prior to full payment. Deposit(s) will be applied towards registration/service fees. Balance of any registration/service fees are due 24 hours prior to the start date of any registered program/service. If full payment has not received prior to this date and/or alternative agreeable arrangements have not been made with Aquatics Academy, will result in the loss of your spot in registered program/session and deposit. HST will be charged on all our programs and services;
Missed Lesson Policy
(g) Acknowledge(s) 1 make up class per student per session can be scheduled. No financial credit/refund will be available in connection with a missed lesson. If cancellation of the lesson is initiated by Aquatics Academy, eg. pool fouling, pool maintenance, then 1 additional make up class will be provided for each class cancelled;
(h) Acknowledge(s) that all make up classes will be held at Aquatics Academy 2 Champagne Dr. Unit E1 North York, Ontario, OK2 (Dufferin St./Finch Ave), even if registered classes are provided at another Aquatics Academy location
(i) Acknowledge(s) that all make up classes will be taken during a week following the end of the current session that will be scheduled by Aquatics Academy. If for whatever reason the scheduled make up class(es) is missed or can not be attended then the said make up class will be forfeited. Make up classes can not be rescheduled and/or carried over to another session;
Refunds/Credits
(j) Acknowledge(s) that there are no refund(s), that a credit towards future Aquatics Academy swim programs/services to be used within the next twelve (12) months (following withdrawal) will be available should a student/participant withdraw and full payment has been collected. The amount of the credit, as applicable, for each
student will be equal to the paid registration fee less an administration fee of $100.00 if cancellation occurs 24 hours prior to session/program start date. If withdrawal occurs after the session/program start date no credit will be issued. A credit will only be provided for medical reasons, which must be supported by written cancellation and a doctor's note. A $100.00 administration fee, plus the cost of classes used up to the date of written notification received, will be deducted from the credit issued.
If cancellation is initiated by Aquatics Academy due to insufficient registration, a full refund (without any deduction) will be issued unless another mutually acceptable alternative can be found;
Class Changes
(k) Acknowledge(s) that a administration fee of $15.00 per student per change will apply if a change is made by the parent/guardian more
than 2 weeks before the start date and $25.00 per student per change if the change occurs within 2 weeks of the start date and/or
during the session. Change requests must be given by written notice. There is no guarantee that a requested change can be accommodated and you will only be charged the admin fee if the change is accepted by Aquatics Academy;
Discounts
(l) Acknowledge(s) no discounts apply to registration in the following programs/courses:
(1) Adult Swim
(2) Leadership
(3) Recertification's
(4) Lifeguard Service
(5) Facility Rentals including Party Packages;
NSF Cheques/Declined Visa/MasterCard
(m) Acknowledge(s) that a cheque returned due to non-sufficient funds must be replaced immediately with cash or certified cheque
or credit card payment covering any amount owing, together with an additional administrative charge of $35.00.
(n) Acknowledge(s) that an invalid or declined Visa/MasterCard payment for any reason, including insufficient funds, expiration
or lost/stolen card must immediately be replaced by providing Aquatics Academy with the full amount owing, together with an additional administrative charge of $15.00;
Class/Program Disruption and Cancellation
(o) Acknowledge(s) that while Aquatics Academy tries to provide sufficient notice of cancellation and not cancelling a class/program
prematurely, Aquatics Academy reserves the right to cancel any class/program at its sole discretion. Notification will occur on a best effort basis ( please check your e-mail, text, voice mail, and our social media channels before you come to the facility). Aquatics Academy will on a best effort basis, extend the session/program to offset the lost class(es). If Aquatics Academy is unable to extend the session/program then a credit will be issued to be used towards any future program and or service offered by Aquatics Academy as per the refunds/credit policy (j). If you are unable to attend the extended class(es), credits and or refunds will not be issued. Cancellation can occur due to reasons beyond Aquatics Academy's control including but not limited to inclement weather, pool fouling, pool condition (maintenance/repair) and public health including epidemic/pandemic;
(p) Acknowledge(s) with respect to any mobile service swim lessons and or lifeguards offered by Aquatics Academy, the additional terms and conditions below also apply:
(1) If a client needs to cancel a booked mobile service for any reason , they must do so at least 3 business days in advanced. If service is cancelled less then the minimum amount of notice, then service is lost and no refund will be issued;
(2) If a service is disrupted by inclement weather (thunder and/or lightning) at any point after service provider arrives at service location if outdoors, the service will be cancelled and no refund will be issued;
(3) Aquatics Academy staff on location will make decision to cancel service due to inclement weather solely based on the safety of all parties. Service may continue to proceed in the rain if there is no thunder and/or lightning;
(4) Service can be cancelled due to inclement weather, up to a maximum of 24 hours prior to the service scheduled time with out loss of service;
Fire Alarm Procedure
(q) Acknowledge(s) that in the event the fire alarm is sounded, I/we must immediately exit the facility;
(r) Acknowledge(s) that in the event a member of my party is responsible for pulling the fire alarm without cause,
I/we will be responsible for any charges incurred as a result of the incident;
Termination of Registration of Participant
(s) Acknowledge(s) that the Directors of Aquatics Academy reserve the right to terminate the registration of any participant(s) if, in their sole discretion, the Directors determine such termination to be in the best interest of the participant or program;
Aquatics Academy Policies
(t) Acknowledge(s) that he/she has read, understands and accepts all of Aquatics Academy's policies and information as outlined, including the following:
(1) Policy that the use of cell phones, cameras and video recording devices in the change rooms and washrooms at any facility operated by Aquatics Academy is strictly prohibited;
(2) Health regulation that no food, drink or street shoes are allowed on the pool deck and or change/washrooms;
(3) Policy that all participants that are under 4 years of age or older children who are not fully toilet trained, must wear an approved reusable swim diaper in any pool operated by Aquatics Academy at all times (no disposable swim diapers allowed). Reusable swim diapers can be purchased at our Champagne Centre Pool. All swim diapers not purchased through Aquatics Academy must be approved for use in our pools by Aquatics Academy;
(4) Policy that no phone registration will be accepted. All registration must be done online or by email. A complete
form, together with necessary payment, are necessary for registration;
(5) Policy that in the event of non-payment of an outstanding balance owing for a specific session in question, the initial
deposit will not be refunded and the reserved space no longer held; and
(6) Policy related to changeroom/washrooms, that Aquatics Academy will not be responsible for supervising such change/washrooms and that clients are expected to comply with age/gender restrictions in the use of such change room. All persons in the facility ages 8 years and older must use their gender specific washroom and showers. If a child is 8 years old or under they must use the gender specific washroom/showers that of their accompanying guardian;
(7) Policy that nude bathing is not permitted in any facility operated by Aquatics Academy
(8) Policy that no changing of clothes and/or diapers is permitted on the pool deck and/or the viewing gallery
(9) Policy that personal belongings are not to be left in the changing cubicles. Please leave all belongings in the provided lockers in the family change room and/or cubbies in the viewing gallery;
Waiver and Release Of Liability
(u) In consideration of being allowed to participate in any way in any Aquatics Academy Inc. program, related events and activities, the undersigned acknowledges, appreciates, and agrees that:
(1) The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
(2) The risk of illness may be present from any and all infectious disease, and while particular rules, equipment, and personal discipline may reduce this risk. the risk of illness does exist;
(3) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
(4) I willingly agree to comply with the stated and customary terms and conditions for participation; and,
(5) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Aquatics Academy Inc (herein known as Aquatics Academy), and 2579267 Ontario Inc, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the program/event ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, ILLNESS from any and all infectious disease or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT TIME OF REGISTRATION)
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above.
