Waiver of Liability, Assumption of Risk, Media Release
RELEASE OF LIABILITY AND ASSUMPTION OF RISK
In consideration of being allowed to participate in any way in Expression City Arts and Fitness, LLC and/or Nashville Circus Center lessons, classes, programs, related events and activities, I, the undersigned, acknowledge, appreciate and agree that:
1. The risk of injury from the activities involved in these lessons, classes, programs, related events and activities is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and
2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation; and
3. I willingly agree to comply with the stated instructions and policies and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest staff member immediately; and
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold harmless Expression City Arts and Fitness, Nashville Circus Center, and their officers, LLC members, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event or activity ("Releases") with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law
RELEASE OF INSURANCE LIABILITY
I understand, agree and acknowledge that some activities may be of a hazardous nature and/or include
physical and/or strenuous activity. Understanding this, I state that I have no medical condition or impairment that might inhibit my safe and active participation in the above listed activity. In addition, I understand that Expression City Arts and Fitness does not provide medical insurance coverage for activity participants and that any applicable medical insurance must be provided individually by such participants. In the case of injury or medical emergency and in the event participant, or their parent or guardian, cannot respond at the time of the emergency, Expression City Arts and Fitness has permission to seek, administer, or have administered whatever first aid or emergency medical care deemed necessary for participant's welfare, and it is understood that participant, and not Expression City, shall be responsible for any and all charges for such health care services regardless of whether participant's medical insurance would cover such charges.
MEDIA RELEASE
I, the undersigned, do hereby consent and agree that Expression City Arts and Fitness, its employees, or agents have the right to take photographs, videotape, or digital recordings of me and/or my minor children and to use these in any and all media exclusively for the purpose of promoting Expression City Arts and Fitness. I do hereby release to Expression City Arts and Fitness, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used. I understand that there will be no financial or other remuneration for recording me, either for initial of subsequent transmission or playback. I also understand that Expression City Arts and Fitness is not responsible for any expenses due to any sickness or injury incurred as a result. I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreement.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND MEDIA RELEASE AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUSTATNTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
MINOR RELEASE
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releases, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless Expression City Arts and Fitness from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, even if arising from their negligence, to the fullest extent permitted by law.

Student Policy

Registration: A non-refundable fee of $35 per student, or $50 per family is due at the time of registration to hold the class spot and cover administrative costs of processing that student.
Class Fees: All class fees are due on the 1st of each month. After the 5th of each month, a late fee of $10 will also be added to the student's account. A $30 fee will be charged for any returned checks. Students who are consistently late on payments may be suspended from class. Class fees do not include art supplies, dancewear, shoes, costume costs, accessories, damage charges, recital fees, or recital tickets.
Trial Class: Classes may be attended as part of a trial program. A student may attend a trial class no more than two times per month. To set up a trial class, the student is required to call in ahead of time to ensure there will be adequate space in the class. Once a student exceeds the number of available trials per class per month (2) he or she will automatically become a monthly student and be charged the semester rate each month. The student may no longer attend the class as a trial for the rest of the semester.
Financial Hardship: If there are any financial hardships, please contact the office to see if you qualify for additional discounts. Discounts are provided for multiple class enrollments and families.
Missed Group classes and refunds: There will be no refunds for classes missed. Semester payments are non-refundable. These payments hold a spot in class for each student. If a teacher cancels a class due to emergency, then the class will either be taught by a substitute or will be made up at a later date. If the student cannot attend the make up lesson provided by the instructor, they may attend another class as a makeup class provided there is a class available.
Missed Private Lessons and refunds: There will be no refunds for classes missed. Semester payments are non-refundable. These payments hold a spot in class for each student. If a teacher cancels a class due to emergency, then the class will either be taught by a substitute or will be made up at a later date. If the student cannot attend the make up lesson provided they can attend a master class at the end of the semester.
Weather Related Closures: ECAF will follow Williamson County Schools for weather related incidents. If ECAF must close or cancel classes unexpectedly due to weather or other "Act of God" circumstances or related incidents, classes will not be made up.
No food or drink: No food or drink is allowed in the dance or music rooms. Food must be kept in the student lounge or kitchen area. Drinks that do not have a sealed lid are not allowed in the studio.
Student dress code: Dance students must wear clothing over their dance wear coming into and leaving the building. Dance shoes are to be worn only inside the studio. No bare-midriffs. Dance students wear hair pulled back (in a bun for ballet class) and appropriate dance wear.
Complete the class: Class will be dismissed by the teacher. If the class begins late, it may end late. If a student needs to be dismissed in class, they must ask the teacher. No student is to leave on their own accord without communication.
Behavior: Students are expected to treat their instructors and peers with respect. No foul language, bullying or continued disruptive behavior will be tolerated. Instructors will utilize the following Three Strike Rule in their classrooms:
1. Verbal Reprimand: Tell the student that their behavior is not acceptable.
2. Time Out: If the student does not respond to the verbal reprimand, then he or she should be removed from the activity and placed in time out.
3. Alert Office Staff - Removal
If the student remains unruly after the first two reprimands, it is the teacher's responsibility to notify the general manager or front office staff by text or phone call to come and escort the child out of the room and a parent will be notified immediately.
Class Changes: If it is necessary to change the student's class or private lesson schedule, the General Manager should be notified with a change request. They will work with the student to properly place them in a new class. The student's new schedule will begin the first week of the following month.
Withdrawals: The General Manager should be notified immediately if a student must withdraw from class. Refunds will not be given for students who withdraw in the middle of the month. As a courtesy, please allow 30 days notice from dropping any classes or private lessons. If a student chooses to withdraw from a class, he or she will not be able to attain a trial pass for that particular class until the following semester. To withdraw from a class, the office must be notified in writing before the end of the month, or the following month will be charged. A student is not withdrawn from class until the office has been notified in writing.
