COVID 19 WAIVER
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Van Metre School of Dance (the "School") and Appalachian Ballet Company (the "Company") have put in place preventative measures to attempt to reduce the spread of COVID-19; however, the School and Company cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the School/Company could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement (the "Waiver"), I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the School/ Company and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the School/ Company may result from the actions, omissions, or negligence of myself and others, including, but not limited to, School/ Company employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with exposure, infection, and/or spread of COVID-19 related to my child(ren)'s attendance at the School/Company or participation in classes ("Claims"). On my behalf, and on behalf of my children, I hereby waive, release, covenant not to sue, discharge, and hold harmless the School and the Company, and their respective owners, directors, trustees, officers, employees, agents, and representatives, as applicable, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this waiver and release includes any Claims based on the actions, omissions, or negligence of the School and the Company, and their respective owners, directors, officers, trustees, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any School or Company program. I understand that this Waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including, but not limited to, claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
I understand and agree that the law of the State of Tennessee will apply to this agreement.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS WAIVER AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED.
Enrollment Agreement Part I
VAN METRE SCHOOL OF DANCE
POLICIES, ENROLLMENT AND CALENDAR YEAR INFORMATION 2020-2021
ENROLLMENT: Enrollment is understood to be for the entire school year, August 10, 2020-May 22, 2021.
CALENDAR 2020-2021: The scheduled closings for 2020-2021 include: Labor Day- September 7; Fall Break- October 3-10; Thanksgiving- November 25-29; Winter Break- December 19 - January 3; Spring Break- March 13-20. Recital will be May 22, 2021. Classes are held on school-in-service days and holidays not listed here. We follow Maryville City Schools for inclement weather closings. Those days are made up with scheduled makeup classes.
RULES: Students must abide by the studio rules. Failure to do so may result in dismissal for cause. (Studio rules at end of document).
TUITION: Tuition is due the first day of each month and must be kept current. By signing this agreement, the undersigned agrees to be personally responsible for all tuition payments required by this agreement. ( Tuition information below).
CLASSES: If a class does not meet minimum number of students for enrollment, this agreement is considered null and void. Classes are nontransferable and may be taken only by named students enrolled in the class.
MISSED CLASSES: No refunds will be made for missed classes. The school will make every effort to allow the student to make up missed classes but cannot guarantee this privilege. Missed classes may only be made up by actively enrolled students within the terms of this agreement and only in cases of illness, family emergency or prior approval. Classes missed due to illness of the teacher, inclement weather conditions, or unforeseen emergencies will be made up on a scheduled date announced by the instructor. Classes missed due to student's other activities OR family vacations will not be eligible for a make-up class.
PHOTOGRAPHY/MARKETING: Van Metre School of Dance and The Appalachian Ballet Company shall have the right to use the name, photograph, videotape or other likeness of the student and to exhibit the same through any medium whatsoever during the term of the agreement or at any time in the future for advertising, promotional, or commercial purposes. All such reproductions shall be the exclusive property of Van Metre School of Dance and The Appalachian Ballet Company.
LIABILITY: As additional consideration for the student's instruction, the undersigned hereby releases Van Metre School of Dance and The Appalachian Ballet Company from liability for any injuries to the person or property of the student or any family member or guest which may occur while participating in the activities of the school and/or The Appalachian Ballet Company. The undersigned agrees to indemnify and hold harmless the Van Metre School of Dance and/or The Appalachian Ballet Company in the event any claims are asserted against the Van Metre School of Dance and/or The Appalachian Ballet Company arising from the student's participation in the activities of the school and/or The Appalachian Ballet Company.
COMMUNICATION: Van Metre School of Dance and the Appalachian Ballet Company may send you information about upcoming events via the email address you provided on the registration form. This is Van Metre's main form of communication with parents and students. There is an opt out option for the Appalachian Ballet Company updates that may be sent to you.
Enrollment Agreement-Tuition
TUITION AND FEES
REGISTRATION: Early registration fee for currently enrolled students is $30.00. After June 18th, 2020, the registration fee for current students is $40.00. For new students, the registration fee is $40.00.
These nonrefundable fees are due with this completed registration form and enrollment agreement when registering for classes for the 2020-2021 school year. Your credit card or bank account (Choose in your portal) will be charged the registration fee at the time of enrollment.
PAYMENTS: Tuition will be charged to your account on the first day of the month with the exception of August, which will be charged on August 10th (first day of classes). If you would like to pay cash or by check in person at the studio, you may still do so but it MUST be received FIVE days prior to the first of the month. Otherwise, your credit card or bank account will be charged.
DELINQUENT PAYMENTS: Tuition is considered delinquent if tuition fees are not paid by the 15th of each month, after which a $15.00 late fee is added to amount due, and at the discretion of Van Metre School of Dance (hereinafter "the school"), a student may not be allowed to continue attending classes until delinquent tuition fees and late fees are paid in full. There will be a $30 fee for all returned checks.
Tuition paid to the school is nonrefundable. Tuition credits will be considered only in cases of prolonged absence due to serious injury or illness substantiated by medical documents. No refunds will be given for withdrawal from classes.
WITHDRAWAL: To withdraw from classes a written notice must be received by the school before the first day of the month of withdrawal. If written notice is not received, responsible party is obligated to pay monthly tuition.
MONTHLY TUITION FEES:
One class per week $60 per month
Two classes a week $85 per month
Three classes a week $120 per month
Four classes a week $150 per month
Five classes a week $180 per month
Six classes a week $210 per month
Seven classes a week $240 per month
Eight classes a week $270 per month
RECITAL COSTUMES: A nonrefundable costume deposit for each enrolled discipline is required for recital.
Costume deposit due on October 1, 2020 $45.00 per costume.
Costume balance due on January 1, 2021 $45.00 per costume.
RECITAL TICKETS: Tickets will be available for purchase in early spring at the Clayton Center for the Arts.
SUMMER CAMP FEES 2020:
Space is limited. Register early.
Fairytale Camp, June 15-19th from 9:00-noon. Tuition is $185.00 with a $100.00 nonrefundable deposit due at time of registration.
Intermediate Camp June 15-19th from 1:00 to 5:00. Tuition is $225.00 with a $125.00 nonrefundable deposit due at time of registration.
Junior Camp July 6-10th from 9:30to noon. Tuition is $125.00 with a $75.00 nonrefundable deposit due at time of registration.
Summer Intensive Camp July 13-24th from -special hours. Tuition is $425.00 with a $225.00 nonrefundable deposit due at time of registration.
The remaining balance for camps can be paid at any time by logging in to your portal. Otherwise, your account will be charged the remaining balance on the first day of camp.
Summer Camp enrollees do not pay an additional registration fee or any costume fees. Those fees apply to those registering for the 2020-2021 school year.
