Participation Agreement and Release
The Toledo Alliance for the Performing Arts (TAPA) is the home of Toledo Ballet, Toledo Symphony School of Music and Toledo Symphony Youth Orchestras. The undersigned student or parent/guardian hereby consents to my or my child(ren)'s participation in the classes, programs, rehearsals, and performances ("Activities") at TAPA education locations or contracted theater space. In consideration of my child(ren)'s participation in such Activities, in addition to the payment of any fee, I do hereby waive, release, and forever discharge TAPA and its trustees, agents, employees, instructors, and all others ("Releasees") from any and all responsibilities or liability for illness or injuries or damages resulting from my or my child(ren)'s participation in any Activities. I do also release all of the Releasees from any responsibility or liability for any illness or injury or damage to myself or my child(ren), arising out of or connected with my or my child(ren)'s participation in any activities with TAPA.
Indemnification
Furthermore, I agree to indemnify the Releasees and each of them from any loss, claim, damage, suit, costs, or expenses, including attorneys' fees and court costs, resulting from or arising out of any illness, injury to any person or damage to property, caused by participation of Releasor in any activities with TAPA.
Release of Liability
I further acknowledge that training and performing can be a potentially hazardous activity. I also understand that such activities involve a risk of injury and even death and that I am voluntarily participating or voluntarily enrolling myself or my child(ren) in these activities with knowledge of the dangers involved. I hereby agree to expressly assume and accept full responsibility for the risks of bodily injury or death while Releasor participates in any Activities with TAPA.
Broad Interpretation of Release
I expressly agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Ohio, and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Medical Authorization
I further authorize TAPA to seek medical attention for myself or my child(ren), if in the judgment of the staff members it should be necessary. In the event I or my child(ren) should require medical attention and/or treatment during the course of any Activities and after a reasonable attempt I cannot be contacted for the purpose of consenting to such treatment in a timely manner, I hereby give permission to any hospital, physician, and/or other appropriate health care provider selected by the staff members to undertake any form of medical treatment considered necessary or appropriate by such provider in such event.
Premises
I also agree that TAPA is not responsible for any student once they leave the instructional premises. TAPA is also not responsible for lost or stolen articles.
Media
I understand that photographers and videographers are often invited to TAPA education programs, classes, rehearsals, and performances for publicity purposes. I agree to the use of my or my child(ren)'s image(s) or likeness(es) in promotional materials including, but not limited to, brochures, newspaper articles, books, television, and/or internet including but not limited to TAPA's websites, the website of local, state and national dance and music, arts and educational organizations and/or publications, as well as social networking sites in perpetuity.
Payment Information
TAPA school tuition is designed to be reasonable and comparable to other nationally accredited and credentialed dance and music training programs. Tuition may be paid either in full or in payments according to the schedules listed herein: please indicate your preference upon registration/enrollment in the payment options field. Tuition will be charged in full for any enrollment totaling less than $100. No refunds or credits will be extended for missed classes due to holidays, weather events or absences. Failure to fulfill payment contracts will lead to penalties including late fees, exclusion from classes or performances, revocation of scholarship aid, and/or dismissal from the school. Classes are filled on a first-paid basis. Returned checks and declined electronic (credit, debit and e-check) payments are subject to a $30 NSF(non-sufficient funds) /card decline fee. Payments will be automatically withdrawn from a designated account on or about a specifically noted date of each month. There is no processing fee assessed for automatic payments or payments made in full prior to the start of the session. If you do not elect automatic payments or the payment in full option; a $60 processing fee may be assessed on the account with the first installment payment for tuition; unless alternative arrangements have been agreed to prior.
Registration/Session Fees
I understand that, in addition to the tuition for my student(s)' enrollment in regular classes, a program registration/session fee will be charged to my account. This session fee is per family and will be charged at the time of initial class enrollment. For Toledo Ballet a session fee of $25 per family is charged for the current session of enrollment; for the Toledo Symphony School (including private lesson students), a per student program registration fee of $125 is assessed annually.
Toledo Ballet Guild Membership
This agreement item is not applicable for Toledo Symphony School of Music or Toledo Symphony Youth Orchestras registrations. (These users should check the box to proceed - no membership charge will be assessed to your account.)
The efforts of the Toledo Ballet Guild afford us the ability to teach, nurture and support our young dancers. The works of the Guild are vital to the sustainability of our organization and our mission. To continue to thrive, the Guild benefits from the involvement of our Ballet family and community. We encourage each family to acknowledge this auxiliary with annual membership dues contribution of $10. By checking the box, you are electing to join. If you choose not to join the Guild, please call the office and this item will be waived.
Refund Policy
Tuition policies differ by school. For Toledo Ballet students, tuition is is nonrefundable after the second week of the general class session except if the student should permanently leave the geographical area, or if there is a permanent medical reason with a signed physician's note. Should the student have a temporary medical excuse, a credit will be applied to their account. For Toledo Symphony Youth Orchestras students these refund policies are the same but are extended to a three week period after rehearsals begin. For students taking private lessons with the Toledo Symphony School of Music an enrollment withdrawal with refund is permitted when two week prior notice is provided. Please reference the handbook of each program for specific guidelines.
Safety/Behavior/Conduct/Rules
I acknowledge that the respective schools and programs have established guidelines and standards for student and parent behavior and conduct. These include health and safety requirements of the Ohio Department of Health and the Lucas County Health Department. I and my student agree to abide by the guidelines and standards as presented in these items. These items are detailed in handbooks and policy statements available on request from the respective schools and programs.
