Release of Liability and Assumption of Risk
READ CAREFULLY BEFORE SIGNING
In consideration of participating in activities at the NFCC, LLC d/b/a Hamilton County Sports Complex, referenced from this point as HCSC, and any of its private entities, including, but not limited to, APGC, Inc. and/or the Party & Play Zone, or any of the individuals that rent space, I represent that I understand on behalf of myself and/or my child the nature of this activity and that I and/or my child am in good physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the Releasees named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in this activity.
I hereby release, discharge, and covenant not to sue HCSC, A Plus Gymnastics Center, Inc and any of its private entities, it's respective administrators, directors, agents, officers, volunteers, employees, other participants, any sponsors, advertisers, owners and Lessors of premises on which the activity takes place, (each considered one of the Releasees herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any loss, liability, damage, or cost which may incur as a result of such claim.
I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. I understand that I have given up substantial rights by signing it and have signed it freely and without any inducement of assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
Parental Consent
AND I, the minor's parent and/or legal guardian, understand the nature of the above referenced activities and the minor's experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees from all liability, claims, demands, losses or damages on the minor's account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor's behalf makes a claim against any of the above Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss liability, damage, or costs which may incur as the result of such claim.
Medical Emergencies
In any event of an accident or emergency I hereby authorize my child to be transported to a hospital for medical treatment and I hold NFCC, LLC d/b/a Hamilton County Sports Complex and any of its private entities, including, but not limited to, APGC, Inc. and/or the Party & Play Zone and any renters and their representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of any injury sustained while participating at or for NFCC, LLC d/b/a Hamilton County Sports Complex and any of its private entities, including, but not limited to, APGC, Inc. and/or the Party & Play Zone and any of the renters.

Enrollment Agreement and Payment Policies
Our monthly tuition is based on flat monthly rates for a four week month. No additional charge is assessed for months that offer five classes. No tuition is reduced in months where holidays, gym closings, snow days, etc. affect the schedule of classes. You are guaranteed 48 classes per year (August 1 through July 31). We have found that during the course of a year this averages out nicely and is a far less confusing payment arrangement for everyone concerned.
Payments are due at the time of registration and on the 15th prior to the upcoming month of every month thereafter.You will be required to have a credit card or debit card on file that will be processed between the 15th and 17th of each month for the following month's tuition. It is understood that once registered, the child is continuously enrolled in class and will incur monthly tuition charges on their account until the parent informs the business office of intent to cancel by submitting a DROP REQUEST FORM. There is a $25.00 fee for dropping after the 14th of the month. It is also understood that any service or product purchased that is not a recurring monthly charge will require payment at the time of purchase. If failure to make a payment occurs, after the 1st, there is a $10.00 late fee for recreational classes.

5. Your account will be set up for automatic payments (AUTO PAY) via your credit card or debit card to be processed between the 15th and 17th of each month.
Tuition is NOT prorated for absences. Please see class Make Up Policies.
If a child misses 2 consecutive classes and tuition has not been paid, he/she will be dropped from the class. If a child is dropped without a written notice from the parents, a $25 fee will be charged to the account and must be paid before child is allowed to re-enroll and attend classes. We reserve the right to cancel a student's enrollment at any time
Withdrawing a Student
We hate to see you go, but we realize that everyone will eventually move on. As a courtesy, we ask parents to notify us in writing by the 14th of the month to cancel for the following month. Written notice is to come in the form of a DROP REQUEST. This form can be printed from our website, or picked up at the front desk. A confirmation of receipt of your Drop Request Form will be given within 2 business days. If confirmation has not been received by the 15th, please follow up with your instructor. If a Drop Request Form has not been received by the 14th, the credit card on file will be charged for the following month's tuition. If a child is dropped after the 14th of the month or without a written notice from the parents, no refund will be given. We reserve the right to cancel a student's enrollment at any time.

Make Up Policies
Tuition pays for your child's spot in the class. However, as a courtesy, we allow one make-up per month, to be made up within three weeks of the missed class. All make-ups must be scheduled in advance. We reserve the right to turn away unscheduled make-ups. Make-ups may not be carried over from one month to another. No credits or refunds will be given for classes not made up. The make-up class must be of the same age and ability level when and where it does not interrupt the safety or the quality of class for those children registered in the class. You must call the gym prior to the missed class to qualify for a make-up. The student must be currently enrolled in class at the time of the scheduled make up appointment and their account must be in good standing. Once made, the appointment cannot be rescheduled. All hour and half and two hour classes if missed will be entitled to just one hour make-up. If your child's class falls on a holiday when the gym is closed, such as Labor Day, Thanksgiving, Memorial Day, or 4th of July, it is your responsibility to schedule your make-up. To schedule a make-up, call our office at (317) 773-7266 or stop by the customer service desk. Once enrollment ceases, all make up options are void.
Media Release
I am aware that individual and group publicity photos and videos are taken from time to time and in consideration for my or my child(ren) participation I hereby grant my permission for my child(ren)'s likeness to be used in NFCC, LLC d/b/a Hamilton County Sports Complex, APGC, Inc., Adamson's Karate Studio, Renters in the Gymnastics Center, and/or the Party & Play Zone publicity or advertising without compensation. These images will not be given or sold to outside companies or individuals. Names of children will not be associated with media in any circumstance. I understand that if I do not want my child(ren) to be subject to the Media Release, that desire must be submitted in writing to the business office so that it may be kept in my child(ren)'s file.
Other NEED TO KNOW INFORMATION
-- JOINING, DROPPING OR CHANGING A CLASS:
Joining: no problem, join at ANY time, your tuition will be prorated.
Dropping: no refunds or credits except with a WRITTEN medical authorization from physician. Once a medical excuse is received, refund will be issued on the card on file. No refunds will be given after the 3 week period has passed.
Changing: no problem as long as there is room in the class you wish to join, unused tuition will be transferred to the new class.
-- CUSTOMER REFERRAL PROGRAM
Did anyone refer you to our gym? They receive $10.00 towards their tuition! Please type their name below in the "Comment" section so they can receive their referral credit! Encourage your friends to take lessons at APGC, inc and you, too, receive $10 off future tuition when they enroll for a full month.
--INCLEMENT WEATHER
If Noblesville School Corporation is closed due to weather, HCSC and APGC, inc will be closed until at least 2 pm. Afternoon Open Work-Outs and Evening Classes will be re-evaluated by 1 pm, and a final decision will be communicated via the HCSC and A Plus websites and outgoing voicemail greeting by 2 pm.
--DROP OFF/ PICK UP
Classes and practices will start on time. Do not drop off students more than 15 minutes prior to their start time. Students must be picked up on time. Parents are required to escort children under the age of 16 into the building to their class area. In the event children are dropped off and not escorted by a parent, Hamilton County Sports Complex, and any of its private entities, including, but not limited to, A Plus Gymnastics Center, Inc., Adamson's Karate Studio, renters in the gymnastics center, and/or the Party & Play Zone will NOT be held responsible for any incidents which may occur. Children under the age of 16 will not be allowed to leave their class waiting area without a parent or guardian.
--During the COVID-19 restrictions please keep children home who are sick, not feeling well or have a fever.
--ATTIRE
Activity Classes: Sports attire should be worn. Athletic shoes with non-marking soles are required.
Gymnastics Classes: Girls must wear a leotard with briefs underneath. Shorts and shirts may be worn over the leotard. NO cropped or halter sport tops which show bare mid-sections. Hair must be tied away from the face. NO jewelry is allowed in class. Boys wear shorts and shirt. NO jeans, shorts or pants with belts or buckles.
--VALUABLES
Valuable items should not be brought to the gym. The Hamilton County Sports Complex and any of its private entities, including, but not limited to, A Plus Gymnastics Center, Inc., Adamson's Karate Studio, renters in the gymnastics area, and/or the Party & Play Zone will not be responsible for lost or stolen items.
--SPECTATORS
Visitors, parents, siblings, and spectators of any kind MUST remain in the designated areas. Please do not talk to or distract the children participating in the classes. Any interruptions could result in serious injury. Violators will be subject to dismissal from the premises. THIS IS SERIOUS.
--INFORMATION CHANGE
It is the responsibility of the student or person responsible for the student to inform APGC of any changes to Address, Phone Number, Email Address, or such pertinent information.
