In consideration of the services of TECHNIQUE, its owners, agents, officers, employees, and all other persons or entities acting in any capacity on their behalf ( hereinafter collectively referred to as "TECHNIQUE") I, hereby agree to release, discharge, and hold harmless, on behalf of myself, my children, my parents, my heirs, assigns personal representative and estate as follows:
1. I understand and acknowledge that the activites that I or my child engage in while on the premises or under
the auspices of TECHNIQUE pose known and unknown risks which could result in injury, paralysis, death, emotional distress, or damage to me, my child, my property, or to third parties. The following describes some but, not all, of those
risks: Cheerleading and gymnastics, including performances of stunts and use of trampolines, entail certain risks that simply cannot be eliminated without jeopardizing the essential qualities of the activity. Without a certain degree of risk, cheerleading students would not improve their skills and the enjoyment of the sport would be diminished. Cheerleading and gymnastics expose participants to the usual risk of cuts and bruises and other more serious risks as well. Participants often fall, sprain or break wrists or ankles, and can suffer more serious injuries. Traveling to and from shows, meets, and exhibitions, raises the possibilities of any manner or transportation accidents. In any event, if you or your child is injured, medical assistance may be required which you must pay for yourself.
2. I expressly agree and promise to accept and assume all of the risks, known and unknown, connected with TECHNIQUE- related activities, including but not limited to performance of stunts and use of trampolines. My participation and
that of my child is purely voluntary. No one has forced or coerced me or my child to participate. I elect for myself and my children to participate in such activites in spite of the risks.
3. I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify TECHNIQUE from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my child's participation in TECHNIQUE- related activites.
4.Should TECHNIQUE be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and reimburse them for such fees and costs.
5.I certify that my child has health, accident and liability insurance to cover bodily injury or property damage that may be caused or suffered while participating in this event or activity, or else I agree to bear the cost of such injury or damage to my child. I further certify that I am willing to assume and bear the cost of all risks that may arise or be created, directly or indirectly, through or by any such condition.
6.In the event that I file lawsuit against TECHNIQUE, I agree to do so solely in the State of Indiana/Illinois and I further agree that the substantive and procedural laws in that state shall apply in any such action without regard to the conflict
of laws rules thereof. I agree that if any portion of this agreement is found void or unenforceable, the remaining portions shall remain in full force and effect.
7.By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation
or the participation of any of my children in this activity, I may be found by court of law to have waived my right
to maintain a lawsuit against TECHNIQUE on the basis of any claim from which I have released TECHNIQUE by signing this Agreement.
I have had sufficient opportunity to read this entire document. I have read it and understand it. I agree to be bound by its terms.

*We are committed to you and we will provide the best customer service to our Technique clients.
*Do not make assumptions about anything. Always ask.
*Attitude is everything. If an athlete or parent has a foul attitude, we will place him/ her to a non-competitive program, such as a class, until improvements are made. Until then, a replacement will be put in position.
*If you are in a tough situation involving strong feelings, we ask that you are considerate and wait 24 hours until you speak with ANYONE, including the other parents or the party to seek resolution.
*Do not call or text the staff unless it is an emergency. The staff needs to have their personal time away from work. Thank you in advance for respecting this rule.
*It is the parent's responsibility to stay informed. Check your Group Me, email and members only section of the website regularly. If you aren't receiving emails, contact the Front Desk ASAP.
*If you have questions, please use the
following chain of command: Team Mom > Front Desk > Coach> Owner
*Cell phones will not be allowed in the GEM during training times.
*All clothing and belongings must be stored on the hooks, not thrown on the floor.
*TECHNIQUE is not responsible for lost or stolen items.
*Siblings of athletes cannot come inside the gym and watch practice unattended. An adult must supervise them outside the gym. We cannot have practices disrupted.
*No one is allowed to make contact with an athlete while in practice.
*You cannot create or sell your own TECHNIQUE apparel or accessories. All TECHNIQUE items will go through the pro shop. This includes mat gifts, personalized shirts, jewelry and other items. Our name and logo is copyrighted. All ideas for apparel must be approved by ProShop Manager or Owner.
*No food or drinks other than water are allowed in the gym.
*Anyone threatening to quit will be asked to leave immediately. The same policy applies to insinuating you are leaving at the end of the season. The culture of Technique must be positive and productive. We have to focus on our program and our athletes. No refund will be given.
*Verbal abuse will not be tolerated. This applies to communication with your athlete(s), other athletes, coaches, staff and other parents. Anyone found behaving in such a manner will be dismissed from the program immediately.
*Your opinion regarding practice and routine construction will not change any. The staff makes all decisions.
*Do not gossip about other teams, parents, other gyms or kids. Again, if you have questions, ASK, rather than listen to non-sense or engage in irresponsible conduct.
*At no time is a parent allowed to approach vendors on behalf of Technique.
*Parents are not allowed to approach judges or competition officials before, during or after an event.
* We encourage all parents to sit together and support all Technique teams. *Parents are also expected to wear Technique clothing to competitions.
*Showing respect for the coaching staff, other teams and hosting organizations is expected, as you are there representing Technique and your child.
*Do not post negative comments, routines or music on message boards, You Tube or any website.
*Always display good sportsmanship, positive conduct and professionalism at all competitions and practices.
*Remove all jewelry, piercings and long fingernails. This is a safety issue!
*Feel free to talk to your coach about anything. We want to make sure the line of communication is open. However, there is an appropriate time. Ask at the front desk to make an appointment to speak to your coach.
Attendance is very important to the success of the teams. Accepting a position at Technique Gems means that it is an athlete's obligation to attend ALL practices, performances and competitions until the end of the season. When one member of a team is absent, it can keep a whole team from achieving their goals. Academics are top priority for our athletes, however time management and prioritization are skills we focus on developing at Technique. Please make sure your student athlete fulfills all of their obligations and balances their schedule accordingly.
Absences that fit the following and have been approved:
•Death in the family
*Technique activities will be communicated via Group me OR on the Google calendar. Please check both regularly.
*Practices may be added or cancelled at the coaches' discretion with notice.
*We will add practices before competitions. Please prepare accordingly.
*October-May, an athlete is only allowed one absence per month. If you miss a practice more than once in a month your spot in the routine will be re-evaluated for the upcoming competitions.
*Missing a practice two weeks prior to a competition may result in the removal of the athlete from the competition routine. Missing practices to finish homework, household chores etc. does not excuse an athlete from practice.
*No more than 8 absences are allowed in a single competitive season (June-April).
*A $25 fine OR 15 min. conditioning will result in an unexcused absence.
*If your athlete is not in the gym with their team when practice starts, your athlete will condition after practice. Please be prepare to stay.
*Withholding your child from practice cannot be used as a form of discipline. This is unfair to the rest of the team.
*We understand there is life outside of cheerleading. Please communicate with us about anything that may interfere with your athlete's practice. If you are going to be absent, for any reason, you must contact the coach as soon as possible. This contact must be made with the coach personally, not through another person or in a group format. If you know of a conflict in advance, please do not wait until the day of to inform us.
*If attendance or tardiness becomes an issue the athlete may be made an alternate or may be dismissed from the program.
I hereby authorize TECHNIQUE to publish photographs taken of my minor child or children listed below for use
in TECHNIQUE's print, online, and video-based marketing materials, as well as other TECHNIQUE publications. I hereby release and hold harmless TECHNIQUE from any reasonable expectation of privacy or confidentiality for myself or the minor child/children listed below associated with the images specified above.
Further, I attest that I am a parent or legal guardian of the child or children listed below and that I have full authority to consent and authorize TECHNIQUE to use their likeness, I further acknowledge that participation is voluntary and that neither I, the minor child, or minor children will receieve financial compensation of any type associated with the taking or publication of these photographs or of said photos confers no rights of ownership or royalties, whatsoever.
I hereby release TECHNIQUE, its contractors, its employees and any third parties involved in the creation or publication of TECHNIQUE's publications, from liability for any claims by me or any third party in connection with my participation or the participation of the minor children listed below.
Competitive cheer, like any other youth sport, has it's expenses. Entry fees for competitions alone are hundreds of dollars a year per athlete. Before you consider this or any program, please carefully consider the financial commitment involved. The difference in costs between our program and others is not as large as you expect. Others may advertise a lower "tuition" rate only to have you pay significant extra amounts throughout the year to the gym. This is why we have adopted an inclusive payment plan.
Outstanding balances will not be tolerated. Pay your bill when you are suppose too! We are a small business, the fees we collect is what we use to pay our employees. When you don't pay, they can't get paid for the services they have provided for you and your child. Should you fall behind, we will make every attempt to collect balances without resorting to the extreme measure of asking your child to leave class, however that is exactly what we will do if you neglect your finiancial responsibility. Constantly paying late will result in dismissal from Technique Gems teams and you will be charged a $400 quitter's fee. This rule will be strictly enforced.
There are no refunds for
the reason - as these costs are paid in advance by Technique and not refundable to us. If an athlete is not able to attend a competition, the Coach and Owner should be notified directly before November 2017. If an athlete is sick or has a last minute emergency, unfortunately we are not able to offer a refund because of this prepayment. If an athlete is unable to fulfill attendance requirements prior to a competition, they will be pulled from the competition without a refund. If an athlete is used to fill your spot in the routine, you are responsible for paying competition costs.
If your athlete is asked to compete on a second team (referred as "crossover") and you accept spots on both teams you are only obligated to pay the monthly tuition for the primary team - not double tuition. However, you will be required to pay your athlete's portion of the second team's competition fee (referred to as "crossover competition fees"). All crossover fees must be paid By August 1st .
For the 2017- 2018 season, crossover fees are approximately $400.00.
Withdrawal from our program
If you quit or are removed from the program, you will not receive a refund of any kind, as well as any undistributed apparel until your account is current including any charges added after the dismissal. Any unpaid balances as well as a $400 quitter's fee for re-choreography are due. Guardians will be responsible for any fees past due, collection costs, court costs and legal fees. (Quitters fee will be assessed on a base by base cases)
Acceptable forms of payment are cash, check, money order, and online portal payments. Anyone with 1 bad check will be required to pay cash, money order or credit card. All fees/dues are final and non-transferable.
Families with multiple athletes will receive 25% off monthly fees for each additional sibling.
Pay season fees in full and receive 10 percent tuition. Discount promotion ends 8/1/17.
