RELEASE OF LIABILITY
As a parent or legal guardian of the child or children named above and/or in my account record for Emerald City Academy of Rhythmic Gymnastics, I give my consent for him / her to participate in the programs at Emerald City Academy of Rhythmic Gymnastics, LLC ("ECARG"). I fully understand that participation in physical exercise involving rhythmic gymnastics, dance, tumbling and conditioning carries a risk of accidents and/or serious bodily injury due to the heights, motions, skill and/or repetition involved. These injuries may include muscle strains and tears, broken bones, and severe injuries such as permanent paralysis or even death. Rhythmic gymnastics requires the use of apparatus which may cause or contribute to personal injuries to me or my child. I agree that the above named minor is voluntarily participating in these activities and that I am fully aware of the risks involved and the possibility of injury that might result.
As ECARG will make no recommendation whether a child is physically fit to engage in any exercise activity, I have evaluated the experience and capabilities of the above named minor and believe that he/she is qualified to participate in the activity. I agree to obtain and provide to ECARG, its coaches and owners, a physician's statement describing any physical condition which could limit this child's participation prior to commencement of activities under this program.
As a parent or legal guardian, I agree to provide health insurance for the minor child or guarantee payment of any medical expenses incurred as a result of training, performing, or participation in activities run by ECARG. I understand that in my absence ECARG does not assume any responsibility for the care, custody, control, condition, health or wellbeing of my child, and has no responsibilities with respect to the safety or adequacy of the transportation of the child to or from the facility. In consideration for allowing the above named minor child to participate in activities with ECARG, I waive any and all rights or causes of action against ECARG, and its administrators, managers, agents, officers, employees, volunteers, contractors, other participants and owners and lessors of the premises where the activity is being conducted (collectively, "Releasees"), for any injuries or other damages suffered by my child or myself while present at the facility or under the supervision or control of ECARG. It is my intent to release all Releasees from liability for future ordinary negligent conduct. I intend this waiver and release to be as broad and inclusive as permitted by the law of the State of California, and agree that if any portion is found invalid, the remainder will continue in full legal force and effect.
EMC Class Policies
EMC memberships run on a MONTHLY tuition schedule. Your tuition for classes is not based on a number of classes, but on a period of time. For weekly classes, in any given month there may be 3,4, or 5 classes. Tuition is due on the first of each month and all families are required to keep a working credit card on file. Tuition may be paid BEFORE the first of the month by other means however, if tuition is not received before the first, the family's credit card on file will be processed for all current charges. If a working credit card is not on file, the account will be charged a $50 fee per student for all unpaid balances after the 5th of the month. EMC memberships are continuous. Each student is enrolled until a parent gives us written notice to disenroll.
To disenroll, EMC requires written notice of the intent to disenroll to be given at least 30 days in advance from the next tuition due date. There are no refunds for membership cancellations and there are no refunds for missed classes. EMC's tuition pays for your child's spot in class, regardless of attendance. Monthly tuition remains consistent, regardless of the actual number of class days per month. Classes have no cash value once missed. EMC offers rescheduled classes for current members for any classes missed and for any days that its gyms may be closed so long as space permits. Rescheduled classes must be scheduled in advance and may not be transferred to another client or used as credit. I authorize EMC to automatically charge my credit card for any balance due. My credit card will be charged on the first of the month for any tuition and current charges and on any date for any past due charges, private lessons or other non-monthly charges. I agree to contact EMC with any concerns, any credit card changes and any credit card expirations at least 7 days before the first of the month to allow time for correction.
