Assumption of Risk
I have read, understand, and agree to the following: I, by checking the box below, represent that I am the minor child's (hereinafter "child") parent or legal guardian. I also represent that I am authorized to sign this waiver. I authorize my child's participating and training in dance and gymnastics at The Power of Dance, LLC ("POD") including the use of its facilities, equipment, and machinery. I understand and acknowledge the nature of the activities my child will be involved in at POD. I understand and acknowledge that participation in dance and gymnastics involves a greater than normal risk of injury and I agree as my child's parent or guardian to assume all risks in connection with my child's participation in dance or gymnastics classes, programs, lessons, meets or competitions. I further understand that participation in dance and gymnastics is potentially dangerous and involves risk of serious injury, even death. Due to the dangers of this activity, I understand the importance of my child's following the teacher's instructions regarding techniques, training, and other rules and agree my child will obey these instructions. In consideration for allowing my child to participate, I assume all the risks associated with the sport of dance. I choose to accept such risks, and I voluntary accept any and all responsibility for my child's safety and welfare while participating in POD. I understand my child's experience, physical health, and capabilities. By checking below, I agree that my child is qualified, in good health, and in proper physical condition to participate in such activities.
COVID-19
The Power of Dance has put in place preventative measures to reduce the spread of COVID-19; however, POD cannot guarantee that you or your child(ren) will not become infected with COVID-19. Our goal is to protect the safety of the studio, our instructors, dancers, and the community we serve. Our staff is symptom-free and, to the best of their knowledge, has not been exposed to the virus. However, since we are a place of public accommodation, other persons (including dancers) could be infected, without their knowledge. Therefore, despite our precautions, there is still a chance you or your dancers may be exposed to the illness.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending POD practices, activities, and events. I am aware and understand the symptoms associated with COVID-19 and will keep the studio promptly informed should my child develop symptoms or come into contact with someone who has tested positive for Covid-19. I will stay up to date with the POD's COVID safety policies and will comply with all safety procedures including wearing a mask if needed unless I have a medical exemption. Release of Liability
I have read, understand, and agree to the following: In consideration of my child's participation with POD, with full understanding of the risks involved, I hereby release, waive, discharge, covenant not to sue, and agree to indemnify, save and hold harmless POD and all of its owners, directors, officers, employees, agents, instructors, contractors, representatives, volunteers and executors, from any and all liabilities, claims, demands, losses, attorney's fees, damages, action and causes of action whatsoever arising out of or related to any loss, damage, or injury including death, that may be sustained by my child , whether caused by the negligence of POD Representatives or otherwise while participating with POD, on behalf of POD, or upon other premises where POD activities are being conducted. I agree to take no legal action against POD or POD staff/volunteers because of an accident or mishap involving the athletic participation of my child, and I authorize emergency medical treatment for my child should the need arise. This release applies to, including by not limited to, any act or occurrence that is caused by or alleged to be caused by, by the negligence of POD including rescue or medical procedures. I further agree that if, despite this release, I, my child, or anyone on my child's behalf makes a claim against POD, I will indemnify, save, and hold harmless POD from any litigation expenses, attorney fees, loss, liability, judgment, damage, or any cost that may occur as the result of any such claim.
Payment Policies
I have read, understand, and agree to the following: Tuition for the summer is due on your child's first day of classes. A $20/class registration fee /class is needed to reserve your child's place- this fee is non-refundable but will be applied to tuition. Tuition for the school year is based on the total hours of class taken per week, calculated by the year and divided into 8 equal payments. Our School year program is a 30-week session beginning in September and ending in late April. By registering for a class, you are instantly signing up for automatic payments to be deducted on the 1st of every month using the credit card or checking account information you have provided. If you wish for payment to be made in a different way, please contact the studio before the 1st of the month. There will be no refunds for missed classes or dropping during the session. Please note, tuition is non-refundable and non-transferable. A $20 late fee will be added if your account is not up-to-date by the 1st of the month. Returned checks will result in a $25 charge followed by payment in cash. The POD has the right to suspend a student if consistent delinquent payments on accounts are received. The POD also has the right to prohibit a student from participating in the annual recital if the account is past due.
Registration Information
I have read, understand, and agree to the following: Classes are filled on a first-come basis and many fill quickly. Performance classes are open for enrollment through the end of November as long as there is room in the class. A yearly registration fee will be charged within 1 week of registration ($25/first child, $15/second - max of $50/family/year. This fee is non-refundable should your child be removed from class. All of our performance classes feature both technique and choreography and are intended for the dancer who begins in Sept and continues through April. (For the Summer, this is a short 5-week program.) All students in performance classes are expected to dance in our Spring Production at the end of the season unless given permission to miss it by the directors. Confirmation of your registration will be sent via email- please make sure we have an email address on file that is checked regularly.
Drop Policy
I have read, understand, and agree to the following: Performance classes can be dropped at any time until the end of October. Non-performance classes, including Adult Classes, Music & Movement, Acro & Leaps/Turns/Jumps may be added or dropped throughout the season. If your dancer needs to be removed from a class and you want your tuition payments stopped, a Drop Form must be submitted. You are responsible for tuition during the month you drop. The date on your drop form or the date of your last class will be your last month of tuition. (Ex. If you drop on October 2nd, you will pay for October's tuition installment, and are able to attend classes that month. This gives us time to fill the open spot in the class.) There is no pro-rating of monthly installments for drops. Therefore, if you can only attend one class in the month you drop, you will still pay the full month's installment. The annual registration fee is non-refundable at any time after enrollment. If you drop a class after Oct 31, you are responsible for the rest of the year's tuition and this will be charged at the time of your departure. If you are dropping after December 1st, please note that a costume has been ordered for your dancer and there are no returns/refunds on costume fees. We will notify you when your costume is ready for pick-up.
Conduct
I have read, understand, and agree to the following: Parents are responsible for the actions of minors while at the studio and in the parking lot. We recommend not leaving young children unsupervised. Please continue conversations with your children about correct behavior including but not limited to- cleaning up after oneself, appropriate noise level and language in the hallway, respect for other dancers and studio equipment, proper use/care of the furniture , proper behavior using the bathroom and water fountains, safe practices in the parking lot and waiting areas, etc. Food, drink, and outside shoes are not allowed on any carpeted area. Parents will be responsible for all damages including cleaning charges incurred by improper use of equipment, roughhousing, and overall not following studio policies. Parents are expected to set a good example for all dancers and follow studio policies as well.
Medical Emergency
I have read, understand, and agree to the following: In any event of an accident or emergency, I authorize POD and/or any appropriate medical facility to take whatever emergency measures (first aid, disaster evacuations, etc.) as judged necessary for the care and protection of my child under the supervision of POD. In the case of a medical emergency, I understand that my child will be transported to an appropriate medical facility by the local emergency unit for treatment if the local emergency resources (police, rescue squad, first responder, ambulance, etc.) deem it necessary. The child will be transported at my (the parent/guardian's) expense. I understand that in some situations, the staff will need to contact the local emergency resource before the parent, child's physician and/or other adult acting on the parent's behalf. I understand and agree that I am responsible for all medical expenses incurred to treat my child's injuries. I further authorize and consent to the use or disclosure of my child's individually identifiable health information should treatment for illness or injury become necessary. Should my child be transported to a hospital for medical treatment, I hold Power Of Dance and its representatives harmless for any such expenses. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of any injury sustained while participating at or for the Power Of Dance.
Photo & Video Release
I have read, understand, and agree to the following: The Power of Dance, LLC reserves the right to use any images of your child, including but not limited to photos and videos, for promotional, marketing and advertising materials (this includes posting on Power of Dance's website and other social media pages).
Electronic Signature
I have read, understand, and agree to the following: By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
