Assumption of Risk

As the parent or legal guardian of the child or children stated above, I hereby consent to his/her participation in the programs, classes, and activities offered at or in association with Flight Deck Gymnastics. This includes all events hosted at the Flight Deck Gymnastics facility at 6073 St Rt 219 Celina, Ohio 45822, and any affiliated events including but not limited to competition, rehearsal, or practice venues in association with participation in any Flight Deck Gymnastics activities . These classes include but are not limited to preschool, recreational, and competitive gymnastics; tumbling, cheerleading, ninja, birthday parties, and special events including clinics, camps, open-gyms, and use of inflatables. By the very nature of preschool, recreational, and competitive gymnastics; tumbling, cheerleading, ninja, birthday parties, and special events including clinics, camps, open-gyms, and use of inflatables all carry an inherent risk of physical injury. No matter how careful the student and coach, no matter how many spotters are used, no matter the degree of skill the student or coach posses, no matter the height associated with the execution of the skill, or height of the equipment used, no matter how many mats or landing cushions are provided, and no matter the frequency of repetition the skill has been performed successfully, the risk cannot be eliminated. Flight Deck Gymnastics aims to reduce risks, but risk is never eliminated in its entirety. In consideration of being allowed to participate in activities at or associated with Flight Deck Gymnastics.
I ASSUME THE ABOVE STATED RISKS AND ALL OTHERS BOTH KNOWN AND UNKNOWN.

Release of Liability

In consideration for allowing my child or children to participate in activities offered by Flight Deck Gymnastics, I, my heirs and assigns, next of kin, and all others acting on my behalf agree to waive any and all rights, claims, damages, actions, causes of action or suits of any kind or nature whatsoever both known and unknown which I have or my child has against Lauren McDonough, Flight Deck Gymnastics, or any coach, instructor, teacher, employee, representative or other acting on their behalf and to indemnify, defend and hold harmless Lauren McDonough, Flight Deck Gymnastics, or any coach, instructor, teacher, employee, representative or other acting on their behalf for any injuries suffered as a result of engaging in any and all activities offered by Lauren McDonough, Flight Deck Gymnastics, or any coach, instructor, teacher, employee, representative or other acting on their behalf from liability for ordinary or gross negligent conduct that may occur in the future and agree not to sue for any amount.
Should any part or parts of this agreement be held null and void, the gross balance of the gross agreement shall remain valid and maintain its full force and effect. This acknowledgment of risk and WAIVER OF LIABILITY has been read by me and understood completely and signed voluntarily. By signing this I am acknowledging I am 18 years of age or older.
By agreeing to this I understand that even though I am not taking preschool, recreational, and/or competitive gymnastics; tumbling, cheerleading, ninja, birthday parties, and special events including clinics, camps, open-gyms, and use of inflatables and any and all other programs and will not be on the equipment I may injure myself being in the gym. I take full responsibility for my actions and agree to pay for any and all medical bills in their full amount that might arise from any and all accidental injuries or discomfort while at Flight Deck Gymnastics, or at any associated event affiliated with Flight Deck Gymnastics. This could include, but not limited to stepping off uneven mats and twisting an ankle, broken bones, torn ligaments, spine injuries or even death. This includes any situations resulting in accidental injuries outside the building in the parking lot and all surrounding areas affiliated with Flight Deck Gymnastics.

Covenant Not-To-Sue

In consideration of my child or children's participation in activities associated with Flight Deck Gymnastics, I hereby release and covenant not-to-sue Flight Deck Gymnastics, or any former or current employees, teachers, coaches, or associated constituents, from any and all present or future claims resulting from accidents or ordinary negligence on the behalf of Flight Deck Gymnastics LLC. or others listed for personal injury or any property damage lost or stolen arising as a result of my child's participation in preschool, recreational, and competitive gymnastics; tumbling, cheerleading, ninja, birthday parties, and special events including clinics, camps, open-gyms, and use of inflatables and any and all other programs offered or any other activities incidental thereto while at or in association with Flight Deck Gymnastics, wherever, whenever, or however the same may occur to the fullest extent of the law.

Medical Emergencies

In agreeing to these terms I am fully aware and understand that the staff of Flight Deck Gymnastics, including but not limited to instructors, coaches, teachers, parents, students, or any other affiliated employee is not a physician or medical practitioners of any kind. With this knowledge in mind, I hereby release and give my full permission and consent for Flight Deck Gymnastics to render first aid to my child in the event of any injury or illness, and if deemed necessary for the student's health, well-being, and human rights to call an ambulance which I, the signer of this agreement, agree to pay for all ambulance costs in full. As a parent or legal guardian, I agree to provide health insurance for the minor child and/or guarantee payment of any medical expenses in their full amount incurred as a result of training, performing, or participation in any and all activities affiliated with Flight Deck Gymnastics.
Does your child have any medical conditions (mental, emotional, or physical) or medications we, as staff members of Flight Deck Gymnastics supervising your child should be aware of, including but not limited to; breathing problems, seizures, allergies, Downs Syndrome, dizzy spells, previous neck or spine injuries or conditions, broken bones, high blood pressure, diabetes, autism, epilepsy, heart condition etc.***ALL ABOVE CONDITIONS REQUIRE A DOCTORS RELEASE claiming your child is fit enough to take "GYMNASTICS", "TUMBLING", "CHEERLEADING", "NINJA" and/or any other events affiliated with the previously stated activities offered and/or affiliated with Flight Deck Gymnastics.

I represent that I understand the nature of this activity and that I am qualified, in good health and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe or I am unable to safely perform any activity, I will immediately discontinue participation in the activity. I fully acknowledge, understand, appreciate and agree, that this activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the Releasees named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the activity. I further acknowledge, understand, appreciate and agree that my participation may result in possible exposure to and illness from infectious diseases, including, but not limited to, MRSA, Influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others and assume full responsibility for my participation and exposure. I hereby release, discharge, and covenant not to sue your business, it's administrators, directors, agents, officers, volunteers, employees, contractors, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of the premises on which the activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, damages, on my account caused or alleged to be caused in whole or in party by the negligence of the RELEASEES or otherwise, including negligent rescue operations and further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the RELEASEES, I will indemnify, defend, and hold harmless each of the RELEASEES from any loss, liability, damage, or cost, which any may incur as the result of such a claim. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITYAGREEMENT, and I understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this Agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. PARENTAL CONSENT I, hereby covenant and promise that I am the minor's parent and/or legal guardian, and on behalf of myself and the minor, understand the nature of the above referenced activities and the minor's experience and capabilities and believe the minor to be qualified to participate in such activity.
