Agreement and Certification

I certify that I am 18 years of age or older and that I have read, fully understand, and agree to the terms of this Agreement, and I sign it voluntarily with full knowledge of its significance.
This Agreement is the sole and entire agreement between Participants and Gymsport with respect to the subject matters described herein, and it replaces all understandings, agreements, representations, and warranties, both written and oral, made on or before the date of this Agreement with respect to such subject matters. If any term or provision of this Agreement is found to be invalid, voidable, illegal, or unenforceable in any jurisdiction, that will not limit, invalidate, or render unenforceable any other term or provision of this Agreement. This Agreement and any related disputes will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to the conflict of law rules of that state. Any claim, controversy, or dispute that arises under or relates to the subject matters of this Agreement that cannot be amicably resolved shall be submitted and adjudicated exclusively by a court of competent jurisdiction in Allegheny County, Pennsylvania.
This Waiver and Release of Liability and Indemnification Agreement (the "Agreement") is being executed by the undersigned adult individual (referred to as "Adult Participant" "I", "me", or "my"), in an individual capacity, with respect to the participation of Adult Participant in certain activities or programs provided by Gympsort, LLC ("Gymsport"). In consideration of the services provided by Gymsport, its agents, affiliates, assigns, owners, officers, representatives, volunteers, employees and all other persons or entities acting in any capacity on its behalf, and as a result of Gymsport permitting Adult Participant to engage in the activities described herein, I, for myself, my spouse, my parents, my heirs, assigns, personal representatives and estate agree as follows:

Acknowledgement of Risk

Gymsport offers athletic training and sports activities pertaining to gymnastics, parkour, freerunning, tumbling, and general movement education. The Activities are provided at Gymsport, 98 Vanadium Road, Bridgeville, PA 15017, inclusive of the associated parking lots, sidewalks, lawns and ground of the facility (collectively, "Facility"). I acknowledge that Participants' participation in athletic training and instruction activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to Participants, to property, or to third parties. Although Gympsort has designed the Activities and the Facility with safety in mind, I understand and acknowledge that all risks simply cannot be eliminated without jeopardizing the essential qualities of the Activities.
The risks include, among other things: slips and falls; falling from equipment; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life threatening hazards; muscular tears, strains, sprains, dislocations, fractures and broken bones; cuts, bruises, and muscle soreness; wrist, arm and shoulder injuries; musculoskeletal injuries including head, neck, and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with the Activities. In any event, I acknowledge that if I or Child Participant are injured, any medical assistance will be at my own expense.
Furthermore, Gymsport employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a Participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
I have advised Child Participant to exercise caution and to follow all posted and verbal instructions of Gymsport's staff while engaging in the Activities and using the Facility. I acknowledge that any injuries that Participants may sustain may be worsened by negligent emergency response or rescue operations of Gymsport. I acknowledge that Participants are voluntarily participating in the Activities and using the Facility with knowledge of the risks involved and I hereby expressly agree and promise to accept and assume all such risks, whether caused by Gymsport's negligence or otherwise.

Participant's Release and Waiver and Indemnification

I, for myself, hereby voluntarily release, waive, forever discharge, losses, rights or causes of action, judgments, awards, settlements, penalties, fines, interest, and costs or expenses of whatever kind, whether known or unknown, (collectively, "Claims) against Gymsport and its employees, volunteers, officers, directors, agents, contractors, insurers, representatives, affiliates, partners, successors and assigns (collectively, the "Protected Parties") arising out of, related to, or on account of any personal injuries or property damaged sustained by Participants (i.e., both Child Participant and/or Adult Participant) as a result of or in connection with Participants' engagement in the Activities or use of the Facility, whether arising out of the negligence of the Protected Parties or otherwise. I further agree, for myself, not to sue the Protected Parties with respect to any such Claims. I understand that this release, waiver and discharge applies to any Claims that I may be able to assert with respect to my own personal injuries or property damage and any medical expenses and loss of services associated with any personal injuries or property damage sustained by myself.
In addition to the foregoing release and waiver of liability, I agree to indemnify and hold harmless Gymsport and the Protected Parties from any and all Claims, demands, or causes of action, which are in any way connected with Participants' (i.e., both Child Participant and/or Adult Participant) participation in the Activities or my use of Gymsport's equipment or Facility, except for those Claims arising solely from the gross negligence or willful misconduct of the Protected Parties. I specifically understand and acknowledge that this provision obligates me to indemnify and hold harmless the Protected Parties from and against any Claims that may later be asserted against the Protected Parties by Child Participant after reaching the age of majority relating to any personal injuries or property damage that may be sustained by Child Participant as a result of engagement in the Activities and/or use of the Facility, even if such Claims would assert negligence or carelessness on the part of the Protected Parties. I further specifically understand and agree that this provision obligates me to indemnify and hold harmless the Protected Parties from and against any Claims that may be made by third persons against the Protected Parties based in any way upon the conduct of Participants.
Should Gymsport or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this Agreement or incur defense costs in responding to Claims, I agree to indemnify and hold them harmless for all such fees and costs.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my or Child Participant's participation in the Activities, I may be found by a court of law to have waived my right to maintain a lawsuit against Gymsport or the Protected Parties on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at Gymsport.

Adequate Insurance

Assumption of Risk and Waiver of Liability Related to COVID

The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Gymsport has put in place preventative measures to reduce the spread of COVID-19 and other diseases; however, Gymsport cannot guarantee that Participants will not become infected with COVID-19 or other diseases. Further, attending Gymsport could increase Participants' risk of contracting COVID-19 or other diseases.
By digitally signing this Agreement, I acknowledge the contagious nature of COVID-19 and other diseases and voluntarily assume the risk that Participants may be exposed to or infected by COVID-19 or other diseases by attending Gymsport and such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 or other diseases at Gymsport may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Gymsport employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to Participants (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or Child Participant may experience or incur in connection with my or Child Participant's attendance at Gymsport or participation in Gymsport programming ("Claims"). On my behalf, and on behalf of Child Participant and my significant other, I hereby release, covenant not to sue, discharge, and hold harmless Gymsport, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Gymsport and its employees, volunteers, officers, directors, agents, contractors, insurers, representatives, affiliates, partners, successors and assigns whether a COVID-19 or other infection occurs before, during, or after participation in any Gymsport program.

Photo Release

I understand that Gymsport periodically takes photos and videos of classes for training, promotions, and social media outlets. Student's personal information (i.e. last name, age, etc.) will never be used. If I do not wish to have my child(ren)'s image used by Gymsport, I will inform Gymsport in writing by emailing lauren@gymsport.com. Participants further release, discharge, and agree to hold harmless Gymsport from any liability that may arise from such use and publicity, including without limitation any claims by Participants for libel or violation of any right of publicity or privacy.
Gymsport has a program wherein webcams are in use. I understand Child Participant is under streaming video surveillance that may be used for training and management purposes, In addition, secure accessibility is available from the web in accordance with the terms and conditions associated with the Spot TV website* (also referred to herein as "Spot TV"). By my digital signature, I hereby consent to the photographing of Participants and the recording of my voice and/or that of Child Participant named herein. I agree that I have no rights to any of the video footage or photographs for any reason at any time. I also agree that I will not screenshot, copy, reproduce, alter, modify, or create derivative works from the Content and Service. I understand that unauthorized recording, duplication, or distribution of this copyrighted work is illegal. I assume full liability of all the terms outlined in this release for any family member's account activity associated with Participants. Copyrighted work includes all web streaming and video/audio recordings. I understand that legal action can be taken against me by Spot TV or Gymsport for such copyright infringement. I understand that the term "photograph" as used herein encompasses still photographs, audio, and motion picture footage.

Behavior

I understand that any child or adult exhibiting behavior that may cause harm to themselves, other participants, or Gymsport staff may be removed from activity. These behaviors include, but are not limited to, hitting, kicking, biting, signs of intoxication or influence of other illicit substances, or other forms of harassment.

Appropriate Attire

Participants should wear athletic clothing. Please, no clothing with buckles, zippers, etc. as these can injure children and damage our equipment. Please keep shirts on. Stomach must be covered. Crop tops/sports bras with no shirts are not permitted. No jewelry should be worn. No outdoor shoes, belt buckles, jewelry or jeans beyond the lobby. You will be restricted to certain equipment if you are wearing unsafe apparel. Cheer shoes (that have been worn indoors ONLY) are permitted on the tumbling floors. No shoes are permitted on the deck.

Gym Rules

- No drinks, gum, or food beyond the lobby.
- No diving head first into the foam pits.
- No horseplay, chasing others or throwing of equipment.
- Share equipment and take your turn.
- One person at a time on any piece of equipment.
- Absolutely NO spotting other athletes.
- Only practice skills that you are capable of performing safely. Gymsport staff members have the right to ask you to stop any skill that looks unsafe. Gymsport provides classes and private lessons if you would like to learn new skills.
- Use equipment as it is designed to be used. If you are unsure, please ask.
- A separate price applies for use of the trampoline deck. Athletes must be 9 years of age or older to use the deck. Athletes under the age of 9 can use the deck if they can safely perform a round off connected to two back handsprings.
