RELEASE and WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”)

Acknowledgement of Risk
In consideration of Busy Kids Gym allowing a student to participate in sports activity and class, including non-gymnastics activities such as dance, cheerleading, martial arts, fitness, and playground activities (hereinafter referred to as the “Activity”) I, and if I am not yet 18 years old my parents or legal guardians, agree to be bound as follows (the term “I” in this release refers to both the child and his or her parents or legal guardians).
Assumption of Risk
As the participant and/or as legal guardian of the participant(s), I recognize that potential severe injuries, including permanent paralysis or death can occur in sports or activities involving high motion, including, but not limited to inflatable’s, gymnastics, tumbling, cheerleading, clinics, camps, private lessons, birthday parties, birthday party guests, bring a friend, play time, field trips, preschool, group activities, family fun nights, parents night out, trampoline, dance, karate, circuit training, running, free weights, conditioning, obstacle courses, personal training, and group fitness. Being fully aware of these dangers, I voluntarily consent for my child(ren) participating in any Activity at Busy Kids Gym and I ACCEPT ALL RISKS associated with participation.
Release to Participate
Representation of Ability to Participate, I understand the nature of the Activity and I represent that the child is qualified, in good health, and in proper physical condition to participate in the Activity. Should I ever believe that any of the above representations have become untrue, or if I should ever believe that the sport is not safe or no longer safe for the child then it will be my immediate responsibility to discontinue the child’s participation in the Activity.
Waiver of Liability
I hereby release, acquit, covenant not to sue, and forever discharge Tetrad Group LLC Doing Business As Busy Kids Gym, its owners, officers, administrators, employees, agents, volunteers, sponsors, advertisers, coaches, and supervisors, and the owners or lessors of any facilities within which the Activity is conducted, their respective agents and employees, and all other persons providing facilities or assisting in the conduct of the Activity (collectively the “Released Parties”) of and from any and all actions, causes of action, claims, demands, liability, losses, or damages of whatever name of nature, including but not limited to those arising from or in any way related to the negligence of any of the Released Parties, that arise out of or are connected in any way to the child’s participation in the Activity and the transportation of the named child to and from the Activity (collectively the “Released Claims”).
Medical Authorization
In the event of an accident or emergency, I hereby authorize my child(ren) to be transported to a hospital for medical treatment and I hold Busy Kids Gym, and their representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by myself or my child(ren) as a result of any injury sustained while participating at or for Busy Kids Gym/Busy Kids Gymnastics.

I have read and understand the promise to pay, acknowledgement and assumption of risk, release to participate, waiver of liability, and medical authorization. I understand that by agreeing to this document, I am giving up substantial rights. I am executing this document voluntarily and with full knowledge of its significance.

Summer camps and all special events through Busy Kids Gymnastics are non-refundable or transferrable. Payments are due at time of registration.

If for any reason your child is sick, displaying illness like symptoms, due to the nature of the event and activity of the students, please refrain from bringing them to the gym on days they are sick, have been exposed to sickness or are displaying illness type symptoms.
