Welcome to Liberty Gymnastics' Sweet Dreams Preschool Summer Camp!

Campers will enjoy working on new gymnastics skills, playing games, and making new friends!
Snacks will be provided. Campers will also make crafts to bring home to their families.

Release and Waiver of Liability Agreement

In consideration of participating in Liberty Gymnastics Training Center's camp program I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity.

I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity.

I hereby release, discharge, and covenant not to sue Liberty Gymnastics Training Center, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim.

I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extend allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

I understand that I have registered my child or children for recreational camps, and/or events at Liberty Gymnastics Training Center, Inc., also referred to herein as Liberty Gymnastics, located at 2330 Bates Ave (Suites A and B2/B3), Concord, California 94520. Liberty Gymnastics has a program whereby webcams are in use and my children are under streaming video surveillance that is used for training and management purposes, in addition to secure accessibility from the web in accordance with the terms and conditions associated with the Spot TV website, also referred to herein as Spot TV. I hereby consent to the photographing of myself and/or my minor child(ren) and the recording of my voice and/or that of my minor child(ren) when we are within the Liberty Gymnastics facilities. I agree that these photographs and/or audio and/or video recordings singularly or in conjunction with other photographs and/or recordings may be used for internal training, management of the facility, advertising, publicity, commercial or other business purposes. I further agree that the video footage is the sole property of Liberty Gymnastics and may only be used by Liberty Gymnastics. I agree that I have no rights to any of the video footage or photographs for any reason at any time. I also agree that I will not screenshot, copy, reproduce, alter, modify, or create derivative works from the Content and Service. I understand that unauthorized recording, duplication, or distribution of this copyrighted work is illegal. Copyrighted work includes all web streaming and video/audio recordings. I understand legal action can be taken against me by Spot TV or Liberty Gymnastics for such copyright infringement. I understand that the term photograph as used herein encompasses both still photographs and motion picture footage. I assume full liability of all the terms outlined in this release for any family member's account activity associated with my child(ren).

COVID-19 Release and Waiver of Liability

The Camper and his/her parent and/or legal guardian (Parent/Guardian), assuming the role of the Camper's designated adult family representative (Family Representative), acting on behalf of the camper's family members and the individuals residing at the same address as the camper (all the foregoing jointly referred to herein as Household Members), in exchange for (i) permitting the student to participate in one or more of Liberty gymnastics programs including camps, and/or events operated by Liberty Gymnastics Training Center, Inc. (herein referred to as Liberty) at one or more of the Liberty facilities (Facilities), and (ii) providing the student, Parent/Guardian, Family Representative, and/or Household Members with limited access to the Facilities as described in the Liberty Gymnastics COVID-19 Business Operation Protocols (Protocols), hereby on behalf of each Household Member and those Household Members' heirs, executors and administrators covenant not to sue any of the Releasees (consisting of Liberty, the owner of the Facilities (Site Owner), any other participants in Liberty gymnastics programs (including but not limited to students, their parents, guardians, family representatives or family members), and the respective owners, directors, officers, employees, agents, contractors, volunteers, associates, affiliates, or other event personnel whether volunteers or paid staff of any of the foregoing). In addition, the Household Members knowingly and willingly release, waive, and discharge from any and all liability, claims, demands, damages, causes of action, losses, or expenses (including attorneys' fees and expenses) to each Household Member, on account of physical, mental, or emotional injury, illness, or death of the person of Household Member or to the property of Household Member, whether such injury or death be caused by the negligence, or gross negligence of the Releasees or otherwise, suffered either during or as a result of the Liberty gymnastics programs or while traveling to or from the Liberty gymnastics programs (with all such claims hereinafter being referred to as the Released Claims). For clarity only, and without limiting the scope of the foregoing, the Released Claims also include therein any and all claims which do or may in the future arise out of and/or are related to injury, illness or death associated with or stemming from the known or expected contraction of COVID-19 or the coronavirus as a result of the attendance at, or participation in, one or more such Liberty gymnastics programs by either student, Parent/Guardian, Family Representative, Family Member, or any Household Member.

COVID-19 Release and Waiver of Liability (Continued)

I, the legal parent/guardian of my child, a student of Liberty Gymnastics, and designated Family Representative acting on behalf of Household Members, hereby acknowledge the following: (i) that each of the Liberty Facilities (Buildings A and B2/B3) are wide open, indoor gym facilities that will each be divided up into multiple workout areas (designated Rooms) within which separate classes involving groups of students will be conducted; (ii) that these Rooms may not be physically separated by walls or any other physical divider, but may instead be separated (depending upon size and location) by no more than 10 feet of space marked off for that purpose; (iii) that air will flow freely between the Rooms in each Facility; (iv) that the students attending the Liberty gymnastics programs will be working out and doing gymnastics in close proximity with, and sharing equipment with, other students in each of the workout Rooms designated for such activity; and (v) that while Liberty is taking the precautions described in the Protocols (outlined in previous sections) for the purpose of diminishing the likelihood of spreading COVID-19 or the Corona Virus between its gymnasts and other Participants, Liberty cannot guarantee persons participating in or associated with the Camps will not be exposed thereto as result thereof. Notwithstanding the foregoing, or any other provision of this Release and Waiver of Liability, Participants release the Releasees from any liability whatsoever arising from any injury, damage, illness or death to Participants during the Liberty Camps where said injury, damage, or death is the result of, or arises from any tortious or criminal conduct upon the part of a Liberty or the Site Owner (or their respective owners, directors, officers, employees, agents, contractors, volunteers, associates, affiliates, or other event personnel whether volunteers or paid staff). Participant hereby assumes full responsibility for, and risk of, bodily injury or illness to or death of Participants due to the negligence or gross negligence of Releasees. Participant also releases Liberty and the Site Owner, but no other Releasee, from any and all liability for the intentional or criminal acts of their respective owners, directors, officers, employees, agents, contractors, volunteers, associates, affiliates, or other event personnel whether volunteers or paid staff while Participant participates in or travels to and from the Liberty Camps. Participant further expressly agrees that the foregoing release and waiver is intended to be as broad and inclusive as is permitted by the law of the State of California, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Participant has read and voluntarily signs this Release and Waiver of Liability, and further agrees that no oral representations, statement or inducement apart from the foregoing have been made, and that this Release and Waiver of Liability may only be modified by a written document signed by Participant and a duly authorized representative of the Liberty Gymnastics Training Center.
