Assumption of Risk & Release of Liability

As the legal parent or guardian, I release and hold harmless World Elite Cheer/ World Elite / World Elite Kids (WE), including Mobile Gym, Tumble Time, Field Trip programs, Events, Miss Katie's Preschool Playgroup, its owners and operators, employees or any other representatives, whether paid or volunteer, from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon the premises or any premises under the control and supervision of World Elite Cheer/ World Elite / World Elite Kids (WE), its owners and operators or in route to or from any of said premises. I am fully aware that any activity involving motion, height, or athletic activity creates the risk of serious injury, and I further agree to hold World Elite Cheer/ World Elite / World Elite Kids (WE) and its staff and officers harmless for any injury or resulting expenses(s). I release and discharge all rights and claims against World Elite Cheer/ World Elite / World Elite Kids (WE) provide the maximum in safety procedures and guidelines, and therefore assume no responsibility for any accidents or injuries that may occur. BEING FULLY AWARE OF THESE DANGERS AND IN CONSIDERATION of the minor being permitted to participate in activities at this facility, I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I, or my child, incur as a result of my child's participation in the activities at this facility. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS World Elite Cheer/ World Elite / World Elite Kids (WE) on my own behalf and the behalf of my child and our respective heirs, administrators, executors, and successors, its officers, directors, shareholders, employees or other representatives, whether paid or volunteer, FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES, WITHOUT LIMITATIONS, ON THE MINOR'S ACCOUNT OR MINE caused or alleged to be caused in whole or in part by the negligence of World Elite Cheer/ World Elite / World Elite Kids (WE), its officers, directors, shareholders, employees or agents. Assumption of Risk & Release of Liability Continued

In Consideration of participation in Gymnastics/Ninja Zone, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe conditions are unsafe, I will immediately discontinue participation in the Activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participation in the event, the conditions in which the event takes place, or the negligence of the "releases" named below. I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity.I hereby release, discharge, and covenant not to sue World Elite Cheer/ World Elite / World Elite Kids (WE)or Ninja Zone, its respective administrators, directors, agents, officers, volunteers, employees, other participants, sponsors, advertisers and, if applicable, owners and lessors of premises on which the Activity takes place (each considered one of the RELEASEES herein), from all liability, claims, demands, losses, or damages on my account caused in whole or in part by the negligence of the "releases" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releases, I will indemnify, save, and hold harmless each of the Releases from any loss, liability, damage, or cost, which any may incur as the result of such claim.

Any and all Ninja skills will be conducted in a safe gym environment and will hold World Elite Cheer/ World Elite / World Elite Kids (WE)and Ninja Zone harmless of any injuries incurred in and outside gym areas.

I have read the Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

Medical Emergency

The undersigned gives permission for the World Elite Cheer/ World Elite / World Elite Kids (WE) owners, officers, employees, and/or agents whether paid or volunteer to seek and give appropriate emergency medical attention for the participant(s) during class, practice or competition, including to or from a competition in the event of accident, injury, or illness in the event they are unable to reach any parent or guardian. I understand that I will be responsible for any and all costs of medical attention and treatment. I represent that the participant is covered by medical insurance. I understand that cheerleading, tumbling, and gymnastics are inherently dangerous and that injuries occur. I represent that I have sought the opinion of the participants physician and that participant is physically fit and mentally capable of participating on a cheer team, gymnastics team, and/or recreational class.

Payment Policies for Events

All events held at our facility will be required to be prepaid. Event fee will be automatically deducted from the card on file upon registration

Payment Policies for Classes & Competitive Teams

Tuition is charged on the 1st of each month and is based on flat monthly rates. Your statement will be emailed to you on the 1st of each month.
Tuition will be automatically deducted from the card on file on the 6th of every month.
All customers are required to have a credit card or debit card on file with World Elite Cheer/ World Elite / World Elite Kids (WE) for automatic, recurring monthly payments.
I understand that the credit card listed on this registration form will be charged at the time of registration.
If you choose to pay by cash/check, it must be received and posted by our business office by the 5th of the month. There is a $30 charge for any checks returned by the bank.
If accounts are paid after the 6th of the month, there will be a $10 late fee applied to the account balance. Failure to pay by the third class of the month will result in removal of your child from class.
Upon enrollment, your credit card will be added to our convenient automatic payment program. Your card will be charged on the 6th of each month. All customers will be automatically enrolled into the next monthly session and charged the monthly fee unless you:
1. Notify our business office by the last day of the preceding month (i.e. You wish to drop your child from the class for May, you must notify by April 30th.)
2. Notification must be given to our business office by calling 330-633-3160 or stopping by the front desk.
I understand that I am financially responsible for payment of all fees at World Elite Cheer/ World Elite / World Elite Kids (WE) for the above athlete including but not limited to tuition, competition fees, registration, uniforms, shoes, choreography, music, classes, private lessons, events, etc.

Non Refundable Annual Membership Fee

All World Elite Cheer/ World Elite / World Elite Kids (WE) classes/programs pay an ANNUAL Membership fee of $45 per family to hold the class spot. This fee is not charged when you register for an event. It is only when you do monthly classes at World Elite Cheer/ World Elite / World Elite Kids (WE). Please be aware this fee is 100% non-refundable should you decide to withdraw from World Elite Cheer/ World Elite / World Elite Kids (WE) classes/programs at any time within the next 12 months from when this fee is paid. Your membership fee will be billed each year on the month of original enrollment.

I also waive any rights to compensation or ownership thereto. I have read this release and I am fully familiar with its contents and competent to make this release. I agree to hold harmless World Elite Cheer/ World Elite / World Elite Kids (WE) from any claims for damage, libel, slander, or invasion of privacy.
