ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT & PERMISSION TO TREAT IN AN EMERGENCY

I acknowledge that I am the parent or legal guardian of the child(ren) identified above and voluntarily authorize my child(ren) to participate in activities at Elite Gymnastics Inc. and/or Elite Ninja Warrior Inc. (referred to as “Elite” for the purposes of this form) I have read Elite's written warning of the dangers inherent in gymnastics and recognize that participating in gymnastics and/or obstacle course activities involves risks of serious injury or death, including but not limited to temporary or permanent muscular and skeletal injury and paralysis.

In consideration of the acceptance of my child(ren)’s registration in Elite’s activities, I and my child(ren) personally assume all risks, whether foreseen or unforeseen, in connection with my child(ren)’s participation in this activity, and we hereby release and waive, discharge, and covenant not to sue Elite Gymnastics Center, Inc., Elite Ninja Warrior, Inc and/or its officers, trustees, employees, agents, and members for any claims, injuries, causes of action, or liability arising from or in connection with my child(ren)’s participation in Elite's activities.

Additionally, we agree to defend, indemnify, and hold harmless Elite together with its officers, trustees, employees, agents and members against any and all liability, claims and causes of action arising out of, or in any way connected with any of my child(ren)’s participation in Elite's activities. Further, I assume complete responsibility for any property damage and/or personal injury caused by any of my child(ren) in connection with his/her/their participation in Elite’s activities.

I have fully and accurately completed the Medical Information section on my child(ren)’s registration form and assert that my child(ren) has/have no physical condition that would prevent or hinder his/her/their participation. I also understand that Elite does not carry Health Insurance and I am liable for any and all medical expenses.

In the event of any injury, I authorize Elite and its employees to administer first aid, transport my child to a hospital, initiate medical treatment and hold my child until I can be notified.

I understand this agreement is a contract and shall remain in effect for the duration of my child(ren)’s participation in Elite activities. This agreement contains the entire agreement between the parties and supersedes any prior agreement whether oral or written. This Release Agreement shall bind my heirs, personal representatives, assignees and all members of my family, including minors.

I understand that my daughter/son may participate in extracurricular events at the gym and studio such as bouncers, relay games, parties for fun. I won’t hold Elite liable for any injuries that may occur during that time.

I understand that I am responsible for supervising my children, while not in class, including siblings in the waiting areas and parking lots. I won’t hold Elite liable for any injuries that may occur during that time.

I have read and agree to abide by the above rules and policies. I am fully aware of and anticipate the risks associated with my child’s participation in class, open gym, or competitions. I further agree that Elite Gymnastics Center, Inc., Elite Ninja Warrior, inc. and all its employees shall not be liable for any losses, damages or injuries that may result from participation in class, competition and / or on the premises.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS APPLICATION AND RELEASE FROM LIABILITY, ASSUMPTION OF RISK AND WAIVER BY READING BEFORE SIGNING IT.
