Big Saturday is a fun event where you can drop off your kids for an incredible night while you get an evening to yourself! Kids will be treated to games, time to jump and play, and pizza. This evening event is for children ages 5 and older. You do not have to be a member at Gymsport to come to Big Saturday, but you must register for the event by the Friday before. Please log back in to the Parent Portal after registering for Big Saturday to process a payment if you were not given the opportunity to do so upon registration. Thank you!

Agreement
This Waiver and Release of Liability and Indemnification Agreement (the "Agreement") is being executed by the undersigned adult individual (referred to as "Adult Participant" "I", "me", or "my"), both as the parent or legal guardian of the minor identified below ("Child Participant") and in an individual capacity, with respect to the participation of Child Participant and/or Adult Participant (collectively, "Participants") in certain activities or programs provided by Gymsport, LLC ("Gymsport"). In consideration of the services provided by Gymsport, its agents, affiliates, assigns, owners, officers, representatives, volunteers, employees and all other persons or entities acting in any capacity on its behalf, and as a result of Gymsport permitting Child Participant to engage in the activities described herein, I, for myself and on behalf of Child Participant, my spouse, my parents, my heirs, assigns, personal representatives and estate agree as follows:
Acknowledgement of Risks
Gymsport offers athletic training and sports activities pertaining to gymnastics, parkour, freerunning, tumbling, and general movement education. The Activities are provided at Gymsport, 98 Vanadium Road, Bridgeville, PA 15017, inclusive of the associated parking lots, sidewalks, lawns and ground of the facility (collectively, "Facility"). I acknowledge that Participants' participation in athletic training and instruction activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to Participants, to property, or to third parties.
Although Gympsort has designed the Activities and the Facility with safety in mind, I understand and acknowledge that all risks simply cannot be eliminated without jeopardizing the essential qualities of the Activities. The risks include, among other things: slips and falls; falling from equipment; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life threatening hazards; muscular tears, strains, sprains, dislocations, fractures and broken bones; cuts, bruises, and muscle soreness; wrist, arm and shoulder injuries; musculoskeletal injuries including head, neck, and back; injuries to internal organs; the negligence of other people; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with the Activities. In any event, I acknowledge that if I or Child Participant are injured, any medical assistance will be at my own expense.
Furthermore, Gymsport employees have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a Participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
I have advised Child Participant to exercise caution and to follow all posted and verbal instructions of Gymsport's staff while engaging in the Activities and using the Facility. I acknowledge that any injuries that Participants may sustain may be worsened by negligent emergency response or rescue operations of Gymsport.
I acknowledge that Participants are voluntarily participating in the Activities and using the Facility with knowledge of the risks involved and I hereby expressly agree and promise to accept and assume all such risks, whether caused by Gymsport's negligence or otherwise.
Participants’ Release and Waiver of Liability
I, for myself and on behalf of Child Participant, hereby voluntarily release, waive, forever discharge, losses, rights or causes of action, judgments, awards, settlements, penalties, fines, interest, and costs or expenses of whatever kind, whether known or unknown, (collectively, "Claims) against Gymsport and its employees, volunteers, officers, directors, agents, contractors, insurers, representativ

Adequate Insurance

I certify that I and Child Participant have adequate insurance to cover any injury or damage I or Child Participant may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. Certification and Authority to Sign

I certify that I am 18 years of age or older and that I have read, fully understand, and agree to the terms of this Agreement, and I sign it voluntarily with full knowledge of its significance.
By signing below, I represent and warrant that I am the parent, legal guardian, or power-of-attorney authorized to bind, jointly and severally, all parents and/or legal guardians of the Child Participant(s) listed below and have the authority to execute this Agreement on his/her or their behalf and to act on his/her or their behalf. I have read each and every paragraph in this document and I and they agree to be bound by the terms stated therein, including the release of liability contained therein. I further agree to indemnify and hold harmless Gymsport from any and all claims which are brought by, or on behalf of Child Participant, and which are in any way connected with such use or participation by Child Participant.

Construction and Interpretation of Agreement

This Agreement is the sole and entire agreement between Participants and Gymsport with respect to the subject matters described herein, and it replaces all understandings, agreements, representations, and warranties, both written and oral, made on or before the date of this Agreement with respect to such subject matters. If any term or provision of this Agreement is found to be invalid, voidable, illegal, or unenforceable in any jurisdiction, that will not limit, invalidate, or render unenforceable any other term or provision of this Agreement. This Agreement and any related disputes will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to the conflict of law rules of that state. Any claim, controversy, or dispute that arises under or relates to the subject matters of this Agreement that cannot be amicably resolved shall be submitted and adjudicated exclusively by a court of competent jurisdiction in Allegheny County, Pennsylvania.

Assumption of Risk and Waiver of Liability Relating to COVID

The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Gymsport cannot guarantee that Participants will not become infected with COVID-19 or other diseases. Further, attending Gymsport could increase Participants' risk of contracting COVID-19 or other diseases. By digitally signing this Agreement, I acknowledge the contagious nature of COVID-19 and other diseases and voluntarily assume the risk that Participants may be exposed to or infected by COVID-19 or other diseases by attending Gymsport and such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 or other diseases at Gymsport may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Gymsport employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to Participants (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or Child Participant may experience or incur in connection with my or Child Participant's attendance at Gymsport or participation in Gymsport programming ("Claims"). On my behalf, and on behalf of Child Participant and my significant other, I hereby release, covenant not to sue, discharge, and hold harmless Gymsport, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Gymsport and its employees, volunteers, officers, directors, agents, contractors, insurers, representatives, affiliates, partners, successors and assigns whether a COVID-19 or other infection occurs before, during, or after participation in any Gymsport program.

Photo Release

I understand that Gymsport periodically takes photos and videos of classes for training, promotions, and social media outlets. Student's personal information (i.e. last name, age, etc.) will never be used. If I do not wish to have my child(ren)'s image used by Gymsport, I will inform Gymsport in writing by emailing lauren@gymsport.com. Participants further release, discharge, and agree to hold harmless Gymsport from any liability that may arise from such use and publicity, including without limitation any claims by Participants for libel or violation of any right of publicity or privacy.
Gymsport has a program wherein webcams are in use. I understand Child Participant is under streaming video surveillance that may be used for training and management purposes. In addition, secure accessibility is available from the web in accordance with the terms and conditions associated with the Spot TV website* (also referred to herein as "Spot TV"). By my digital signature, I hereby consent to the photographing of Participants and the recording of my voice and/or that of Child Participant named herein. I agree that I have no rights to any of the video footage or photographs for any reason at any time. I also agree that I will not screenshot, copy, reproduce, alter, modify, or create derivative works from the Content and Service. I understand that unauthorized recording, duplication, or distribution of this copyrighted work is illegal. I assume full liability of all the terms outlined in this release for any family member's account activity associated with Participants. Copyrighted work includes all web streaming and video/audio recordings. I understand that legal action can be taken against me by Spot TV or Gymsport for such copyright infringement.
I understand that the term "photograph" as used herein encompasses still photographs, audio, and motion picture footage.

Behavior

I understand that any child exhibiting behavior that may cause harm to themselves, other students, or Gymsport staff may be removed from class/activities. These behaviors include, but are not limited to, hitting, kicking, biting, or other forms of bullying or harassment.

Appropriate Attire

Participants should wear athletic clothing. Please, no clothing with buckles, zippers, etc. as these can injure children and damage our equipment. No jewelry should be worn. Please keep shirts on. Stomach must be covered. Crop tops are not permitted. No outdoor shoes, belt buckles, jewelry or jeans beyond the lobby. You will be restricted to certain equipment if you are wearing unsafe apparel.

Gym Rules

- No drinks, gum, or food beyond the lobby.
- No diving head first into the foam pits.
- No horseplay, chasing others, or throwing of equipment.
- Share equipment and take your turn.
- One person at a time on any piece of equipment.
- Absolutely NO spotting other athletes.
- Only practice skills that you are capable of performing safely. Gymsport staff members have the right to ask you to stop any skill that looks unsafe. Gymsport provides classes and private lessons if you would like to learn new skills.
- Use equipment as it is designed to be used. If you are unsure, please ask.
- Keep language clean. No profanity.
- Be respectful of other participants, Gymsport staff, and Gymsport property.
