Assumption of Risk and Waiver of Liability
1. Assumption of Risk
By participating in the activities and programs offered by Small Talk L.L.C. ("Small Talk"), I acknowledge and agree to the following:
I understand that participation in Small Talk activities, including but not limited to playgroups, classes, and events, involves inherent risks, including the risk of physical injury or illness.
I voluntarily assume all risks associated with participation in Small Talk activities, whether known or unknown, including but not limited to risks of physical injury, illness, and any other potential harm to myself or my child.
2. Waiver of Liability
I hereby release, waive, discharge, and hold harmless Small Talk, its owners, employees, volunteers, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my child, or to any property belonging to me or my child, while participating in Small Talk activities or while on the premises.
3. Indemnification
I agree to indemnify and hold harmless Small Talk, its owners, employees, volunteers, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of my or my child's participation in Small Talk activities and to reimburse them for any such expenses incurred.
4. Medical Treatment
I authorize Small Talk to obtain necessary medical treatment for me or my child in the event of an emergency and agree to bear the costs of any such treatment.
I understand that Small Talk does not provide medical insurance for participants and that I am encouraged to have health insurance coverage for myself and my child.
5. Agreement to Policies
I acknowledge that I have read and understood the Health and Safety Policies, including the Illness Policy, Shoe Policy, Sanitization Policy, Staff Illness Policy, and Handwashing Policy, and agree to comply with all such policies.
Health and Safety Policy
At Small Talk, we welcome children as young as 6 weeks old. Therefore, we take extra precautions to ensure the safety and well-being of all our attendees, especially the youngest ones.
To maintain a safe and healthy environment, the following policies are in place:
Illness Policy: If you or your child is sick, please do not attend classes. If you or your child arrive visibly ill, you will be asked to leave and will not be offered a makeup class. However, if you do not show up to a class due to illness, you will have the opportunity to make it up at a later date.
Shoe Policy: Everyone, both children and adults, must remove their shoes upon entering the facility. No exceptions will be made.
Sanitization Policy: All items used during playgroups will be thoroughly disinfected before the next session by a staff member.
Staff Illness Policy: If a staff member or their child is sick, classes will either be rescheduled or refunded at the owner’s discretion.
Handwashing Policy: Both adults and children are required to wash their hands after using the restroom or changing a diaper.
Photo and Video Policy
At Small Talk, we understand that parents have varying preferences regarding the photography and sharing of their children's images. We recognize this is a deeply personal and sensitive matter. To respect all families and ensure a comfortable environment, we ask that all adults attending playgroups or events refrain from using their phones for photography or video recording.
Taking photos or videos during playgroups or events can inadvertently capture other children, which may not align with their parents' wishes.
However, we do understand the desire to capture special moments and memories. If you wish to take a photo of your child or your child with others, please follow these guidelines:
Seek Staff Approval: Before taking any photos, ask the staff member running the playgroup if it is an appropriate time to do so. The staff member will help ensure that no other children are in the frame.
Obtain Permission: If you wish to take a photo that includes other children, you must first obtain express permission from the parents of those children.
While we cannot enforce these guidelines in totality, we kindly ask all attendees to be mindful and considerate of these requests to maintain a respectful environment for everyone.
Important Notice Regarding Building Access Policy
B&L Properties, the manager of the building housing Small Talk Child Enrichment Center, has implemented a new policy that requires all exterior building doors to be locked 24/7. As a result, all visitors to Small Talk must be let into the building by the staff member conducting the class at that time. Please note that the building entrance and the entrance to Small Talk are separate. Visitors must notify staff of their arrival via text message (instructions will be posted on the door).
