Welcome! We are excited for Fall Movement Story Time with the Village of Cottage Grove Library Programing collaboration with Communication Innovations and Dolphin Swim Academy. Story Time will start promptly at 10:00am and go until 10:30am. Then participants will have 15 minutes to change for Open Swim which will be from 10:45am to 11:15am. Each child swimming will need to have an adult with them. No exceptions. Any child not 100% toilet trained will need to have a reusable swim diaper. No exceptions. Dolphin Swim Academy will be closing at 11:30am, there will not be time to play in the lobby after swim and story time. If you are a current or past family with Dolphin Swim Academy or Flip & Dip Summer Camp, you already have a JackRabbit account and can login and register through your account. Limitations of Damages

I agree that my sole remedy, and the sole remedy of the Participant, his/her parents and legal guardians is a refund of the enrollment fee paid to Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC for the program session in which any injury, death or property damage occurs. In no event shall the liability of Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC or any of its affiliates or partners, if any, to the Participant, the parent or legal guardians of the Participant, or any third party, whether in contract, tort (including negligence), or otherwise, exceed the enrollment fee (or portion thereof) actually paid to Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC for the program session during which such loss or damage occurs.

Waiver of Right to Bargin and Release of Liability Parties

I, on behalf of myself and the Participant, hereby RELEASE AND FULLY DISCHARGE Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, Jump Around Gymnastics, its owners, directors, officers, employees, agents and representatives (the "Dolphin Swim Academy, LLC and Parties") from all claims and liabilities for any damage to property or personal injuries or damages, including death, caused by the BREACH OF ANY EXPRESS OR IMPLIED WARRANTIES or the NEGLIGENT ACT or OMISSION of any Dolphin Swim Academy, LLC and Parties in connection with the Participant's engagement in organized programming. The foregoing release does not include claims for personal injuries caused by intentional or reckless conduct by any Dolphin Swim Academy, LLC and Parties. Except as expressly excluded by the previous sentence, this release includes all claims and causes of action of any type whatsoever, whether based on statute or common law or otherwise, relating in any way to any property damage or personal injury (including death) the Participant or undersigned may suffer in connection with accessing, using, or being present at the property to participate or engage in any organized programming, even if caused by the negligence or other improper (but not intentional) conduct of Dolphin Swim Academy, LLC and Parties. I will never assert any claim or lawsuit, based on any of the claims, injuries, damages or matters released in this paragraph against any Dolphin Swim Academy, LLC and Parties.

Personal Property and Appearance Release

I understand that any items the Participant or I bring to lessons (camera, personal electronics, etc.) are the responsibility of the Participant or me, and Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC is in no way is responsible for lost or stolen items. Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC may capture photos and video and/or audio recordings of the Participant during swim lessons or other programming (excluding usage of locker rooms), and may use and publicly disclose such photos and recordings for promotion of Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC and Dolphin Swim Academy, LLC, Flip & Dip Summer Camp, LLC's programs or in any other commercial manner.

Assumption of Risk

I acknowledge and fully understand that the Participant will be engaging in activities at Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and other affiliates that involve risk of injury. These activities include swimming and other in-pool and on-land activities that involve the risk of tripping, falling, slipping, drowning and similar risks that could result in serious injury and/or death, and other activities that involve the risk of tripping, falling, slipping, drowning, vehicle related collisions, and similar risks that could result in serious injury and/or death. There may be other risks not known to Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and other affiliates or not reasonably foreseeable at this time.
I assume all the foregoing risks, accept personal responsibility for any damages incurred by the Participant and/or his/her parents or legal guardians following such injury, permanent disability or death, and agree to indemnify and hold Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and its affiliates and partners in the operation of the programming harmless from and against all claims, costs, expenses and liabilities, including attorney fees, for injury to person or property arising in connection with the Participant's participation in Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and affiliates programming and/or use of facilities and equipment owned by Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and/or its affiliates or partners. Medical Care I authorize Dolphin Swim Academy, LLC, Porpoiseful Planning, LLC, Flip & Dip Summer Camp, LLC, and other affiliates to seek all reasonable medical and surgical care that may be necessary as a result of any injury the Participant sustains during programming if the Participant is unable to authorize such care for him/herself.

General Information

Please be respectful of the property, staff members, and families at Dolphin Swim Academy. Each family will need to have a signed Waiver(These Policies and Procedures). Parents, Guardians, Care Givers must remain on the property during the lessons and keep a watchful eye on their swimmers at all times. Please keep swimmers away from the pool edge and out of the water until the start of their swim lesson.
Any child not toilet trained will need to wear a reusable swim diaper. Disposable diapers or Huggies Little Swimmers are not allowed in the pool. They will break down and not hold in fecal matter. Reusable swim diapers can be purchased at local retailers, amazon, and here at DSA! Our favorite brand is Splash About! Happy Nappy, these diapers are comfortable, fit the best, and allow for the best movement in the water.
Please if your child has any open wounds or is ill with any of the following prior to their swim lesson please keep them home until they are clear of symptoms for 48 hours. - Fever - Stomach Flu - Strep Throat - Influenza - Diarrhea - Pneumonia - Ring worm - Other contagious and infectious illnesses or diseases We want to make your time in lessons a memorable and joyful experience.

Weather Policy In case of tornado, shelter in the inside of the locker room away from windows. In case of fire, exit the building using the closest Emergency Exit, gather away from the building by area DSA staff is ushering patrons to, so we can get a count to make sure everyone is out. In case of snow or other severe weather conditions, Dolphin Swim Academy will cancel morning lessons if Monona Grove School District closes, evening lessons will be determined by 1:30pm as to opening or closing. Saturday lessons will be notified by 7:30am and Sunday lessons will be notified by 11:00am to open or close due to inclement weather. Morning classes will be notified by 8:00am. -If you feel that it is unsafe to travel to lessons, please call and let us know and we will try to get a makeup lesson scheduled. Makeup lessons are not guaranteed, as we cannot control the weather, we will try our best to reschedule the missed lesson.

Swim Diaper Policy

Any child not toilet trained or newly toilet trained will need to wear a reusable swim diaper. Diapers should be snug around the thighs and hips. Please do not purchase a diaper to "grow into" as these are not snug and if any accident should occur it will not be contained within the diaper. Fecal accidents are costly to Dolphin Swim Academy and an inconvenience to Families as they may require us to shut down for a period of time.
Disposable diapers or Huggies Little Swimmers are not allowed in the pool. They will break down and not hold in fecal matter. Reusable swim diapers can be purchased at here at DSA! Waiver of Right to Bargin

I have considered that if this Waiver and Release of Liability was not as broad as it is, the enrollment fee for Dolphin Swim Academy, LLC's programming might be considerably higher. Since I do not wish to pay a higher enrollment fee, I waive the right to bargain for different terms under this Agreement. I expressly understand that in lieu of agreeing to the terms contained in this Agreement, I may contact the Manager of Dolphin Swim Academy, LLC at 608-315-7946, and attempt to bargain for terms different from those contained in this Agreement. By clicking the "accept" button, I understand that I am waiving my right to bargain and accepting the terms contained herein. I acknowledge that, in the absence of a written agreement signed by a Dolphin Swim Academy, LLC Manager, the Participant's participation in the Dolphin Swim Academy, LLC programming shall constitute my acceptance of the terms contained in this Agreement.

Severability

If any portion of this Agreement is held invalid, it is agreed that the balance shall continue in full legal force and effect. I acknowledge that I have carefully read the above terms of this Agreement, understand its contents, and I recognize that by signing this Agreement on behalf of myself, the Participant, and the other parents and guardians of the Participant, we are freely giving up substantial rights and assuming risk of injury, death and property damage as discussed herein.
