STREET KINGS ACADEMY OF DANCE INC.
PARTICIPANT RELEASE, WAIVER, AND ACADEMY POLICIES
WARNING: BY CHECKING THE BOX, CLICKING "I have read and agree.", AND SUBMITTING THIS FORM, YOU EXECUTE A LEGALLY BINDING DIGITAL SIGNATURE AND WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY.
TO: STREET KINGS ACADEMY OF DANCE INC. and their respective subsidiaries, affiliates, directors, officers, partners, shareholders, employees, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, builders, designers, manufacturers, successors, and assigns (collectively referred to as the “Releasees”).
DEFINITIONS:
- “Dance Studio”: In this Release Agreement, the term “Dance Studio” includes, but is not limited to, all facilities, dance floors, exercise areas, lobbies, viewing areas, and equipment contained within the Releasees’ premises at all locations operated by Street Kings Academy of Dance Inc., as well as any off-site events, competitions, battles, shows, performances, workshops, staging areas, or virtual training sessions.?
- “Participant”: Refers to any and all individuals registered for instruction, classes, workshops, or training under this account. This includes both the enroled student(s) and/or the parent/legal guardian if they register or participate in any active instruction.?
- “Guardian”: Refers to the parent or legal guardian executing this agreement below. If the Guardian registers for or participates in classes, sessions, or studio events, they automatically assume all responsibilities, liabilities, and waivers of a Participant under this Agreement. Both Participant and Guardian are bound collectively by all terms herein.?
1. ASSUMPTION OF RISKS
I am aware that presence at or participation in the Dance Studio involves many risks, dangers, and hazards including, but not limited to: slips; falls; collisions or impacts with objects or other persons; loud noises; mechanical failure of equipment; loss of balance; physical exertion; difficulty or inability to control one’s speed and direction; variation in floor surfaces; and NEGLIGENCE ON THE PART OF THE RELEASEES, including the failure on the part of the Releasees to safeguard or protect me or the Participant(s) from the risks, dangers, and hazards of the Dance Studio.
I AM AWARE OF THE RISKS AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS TO MYSELF AND/OR THE PARTICIPANT(S), AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS RESULTING THEREFROM.
2. RELEASE OF LIABILITY & INDEMNITY
In consideration of the Releasees allowing my or the Participant’s presence, enrolment, or participation at or in the Dance Studio, I hereby agree as follows:
TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Releasees and to release the Releasees from any and all liability for any loss, damage, expense, or injury including death that I or the Participant(s) may suffer, due to any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE (INCLUDING THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c. 337) on the part of the Releasees.
INDEMNITY AGREEMENT: I AGREE TO HOLD HARMLESS, DEFEND, AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property or personal injury to myself or the Participant(s). I acknowledge that I am personally responsible for any and all legal fees, costs, and damages incurred by the Releasees in the event of any legal claim arising from my or the Participant's participation or presence on the premises or at any external venue.
3. MANDATORY INSURANCE REQUIREMENT
It is a mandatory requirement for enrolment that all students and active participants maintain their own medical and accident insurance coverage through a personal or family policy. Street Kings Academy of Dance Inc. does not provide medical insurance for participants. Any medical costs incurred due to participation are the sole responsibility of the account holder’s personal insurance provider.
4. DAILY STUDIO FILMING, LIVE EVENTS, AND COMPREHENSIVE MEDIA RELEASE
A. Operational Reality & Context: Street Kings Academy of Dance Inc. is a highly active, media-driven training facility. Content creation, video analysis, and photography occur daily within our premises. Continuous filming and photography are an inherent part of our everyday environment. This includes standard classes, choreography sessions, workshops, community battles, and showcases.
B. Applicability to Spectators, Participants, Guardians, Attendees, and Venues: Because our programs feature open training areas, active common spaces, and take place across various public and private environments, any individual entering the Dance Studio premises or attending a studio-sanctioned event at an external venue—including parents, guardians, and spectators—may be captured in video, photographic, or audio recordings. Due to the continuous, fast-paced nature of our training, battles, and showcases, the Releasees cannot guarantee the exclusion of background individuals, nor do they assume any obligation to monitor, filter, or obscure persons who appear incidentally in the background of classes, lobbies, staging areas, or event spaces.
C. Scope of Rights Granted: I hereby grant the Releasees the absolute, irrevocable, perpetual, worldwide, and royalty-free right to record, photograph, film, and capture the image, visual likeness, voice, audio recording, and name of both myself and the Participant(s) (collectively, the “Likeness”).
D. Authorized Channels and Mediums: I agree that the Releasees may use, reproduce, distribute, edit, modify, display, and publish the Likeness, in whole or in part, across all modern marketing, advertising, and promotional channels, including:
- Social Media & Video Distribution: Instagram, TikTok, Facebook, YouTube, Vimeo, and all other video-sharing or digital content platforms.?
- Digital, Web, & Broadcast: Official studio websites, digital advertisements, email campaigns, online training portals, and event livestreams.?
- Print & Physical Media: Promotional brochures, print advertisements, posters, banners, billboards, apparel, and physical studio signage.?
E. Ownership & Complete Waiver: I acknowledge that all footage, photos, and marketing materials created by the Releasees remain the sole and exclusive property of the Releasees.
- I waive any right to inspect or approve the finished product, video edit, or print proof.?
- I waive any right to royalties, financial compensation, or residual fees arising from the use of the Likeness.?
- I hereby waive all Moral Rights in the Likeness in favour of the Releasees under the Copyright Act of Canada.?
5. BINDING ACKNOWLEDGEMENT
This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, and representatives. This Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia. Any litigation involving the parties shall be brought solely within the Province of British Columbia.
I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT. I am aware that by checking the box, clicking "I Accept", and submitting this form, I am executing a legally binding digital signature and waiving certain legal rights which I, my child/children, or my heirs, next of kin, executors, administrators, and representatives may have against the Releasees. I confirm that I am the legal guardian of the student(s) registered within this account, and/or that I am executing this agreement as an adult participant registering for myself.
