Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to be spread mainly from person-to-person contact. The Conservatory cannot guarantee that you or your child(ren) will not become infected with COVID-19. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Conservatory and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Conservatory may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Conservatory employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at the Conservatory or participation in Conservatory programming ("Claims"). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Conservatory, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Conservatory, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Conservatory program.

Dance and the required level of training and performing with which it is associated place unusual stress on the body and carry with it the risk of physical injury. On behalf of my child and myself (and if I am no longer a minor, on my own behalf), I assume the risk and agree that Cary Ballet Conservatory and the staff of these institutions shall not be liable in any way for injuries sustained during any CBC activity. It is also understood that dance instruction involves kinetic corrections that may include physically touching a student as part of regular class work and rehearsals. Students who have concerns about this should speak with their instructors before the class begins. I assume the risk and agree that Cary Ballet Conservatory and the staff of these institutions shall not be liable in any way for injuries sustained during attendance at this Intensive or any of its related functions. As a participant or as a parent/guardian of Cary Ballet Conservatory dance programs, I recognize and acknowledge that there are certain risks of physical injury and I agree to assume full risk of any injuries, including damages, death or loss which may be caused as a result of participation in any activities connected with Cary Ballet Conservatory. I agree to waive and relinquish all claims against Cary Ballet Conservatory and its owners, faculty, staff and consultants from all claims resulting from participation in a program. In case of accident or sickness, I consent to emergency medical care for my child/myself to be provided by ambulance or hospital personnel.

Cary Ballet Conservatory shall have the right and permission to use, publish, and/or reproduce photographs, film, and videotapes taken by any staff member or approved photographer. All publicity during the term of this agreement shall be under the Conservatory's control, and the Student shall cooperate by engaging in such publicity and activities as directed by the Conservatory. The Parent(s) or Guardian(s)/Student agrees to allow the Student's name, photograph, voice, image, and information to be used by Cary Ballet Conservatory for use in any publications, promotional materials, any company sanctioned marketing or advertising and website, without compensation and without prior notice. Photos are allowed to be taken of students during any open classroom or approved events. Parent(s) or Guardian(s)/Student also allows student to be interviewed by the media on campus or at school-related events. Parent(s) or Guardian(s)/Student releases and holds the Conservatory harmless from any liability stemming from the use of the Student's name, photograph, voice, image, or information. Also, online (Zoom/Facebook/Instagram/Twitter/social media/internet/websites/blogs/podcast/news) broadcasts and classes (including but not limited to choreography) are the property of Cary Ballet Conservatory. All work prepared by an employee within the scope of his or her employment is the property of Cary Ballet Conservatory.
