GYMSTARS GYMNASTICS, INC. RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

FOR AND IN CONSIDERATION of being permitted to utilize the facilities, services and programs of GymStars Gymnastics, Inc. (or for my children to participate) for any purpose, including, but not limited to observation, use of the facilities or equipment, or receiving instruction, training, or supervision, participation in any onsite or off-site program with, on behalf of, or affiliated with GymStars Gymnastics, Inc., or travel to and from any off-site program, THE UNDERSIGNED, for himself or herself and such participating children and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has, or immediately upon entering or participating, will inspect and carefully consider such premises and facilities and/or the program. It is further warranted that such entry into the GymStars Gymnastics premises for observation or use of any facilities or equipment or participation in any program constitutes an acknowledgment that such premises, all facilities and equipment thereon, and such programs have been inspected and carefully considered and that the undersigned finds and accepts same as being safe and reasonably suited for the purpose of such observation, use, or participation by the undersigned and such children and assumes the risks arising from the conditions of the premises, equipment and/or program. I further acknowledge, understand, appreciate and agree that my participation, or my children's participation, may result in possible exposure to and illness from infectious diseases, including, but not limited to, MRSA, Influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation and exposure.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER GYMSTARS GYMNASTICS FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO, OBSERVATION, USE OF FACILITIES OR EQUIPMENT, RECEIVING INSTRUCTION OR TRAINING, OR PARTICIPATING IN ANY ON-SITE OR OFF-SITE PROGRAM AFFILIATED WITH GYMSTARS GYMNASTICS, INC., THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING:

1. THE UNDERSIGNED, ON HIS OR HER BEHALF AND ON BEHALF OF SUCH CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE GYMSTARS GYMNASTICS, INC., its directors, officers, employees, coaches, volunteers and agents (hereinafter referred to as "releasees") from all liability to the undersigned or such children and all their personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefor on account of injury to the person or property or resulting in death of the undersigned or such children whether caused by the negligence of the releasees or otherwise while the undersigned or such children are in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with GymStars Gymnastics, Inc.

2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them, from any loss, liability, damage, or cost they may incur due to the presence of the undersigned or such children in, about or upon the premises of GymStars Gymnastics, Inc. or in any way observing, or using the facilities, or equipment thereon, or participating in any program affiliated with GymStars Gymnastics, Inc. whether caused by the negligence of releasees or otherwise.

3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the undersigned or such children due to the negligence of releasees or otherwise while in, about or on the premises of GymStars Gymnastics, Inc. and/or while using the premises or any facilities or equipmen

The undersigned certifies that the participant is mentally and physically capable and able to fulfill the requirements to participate in any class, competition, performance, trip and/or event sponsored by GymStars Gymnastics, Inc. I also affirm that I now have and will continue to provide proper hospitalization, health and accident insurance coverage, which I consider adequate for both my child's protection and my own protection.

I certify as the primary contact that I am the parent/guardian of the enrollee, and give permission and hereby authorize GymStars Gymnastics, Inc. and it's employees to give consent for my child or myself to receive medical treatment in the event that I cannot be reached or I am otherwise unable to respond.

I hereby agree to Authorize GymStars Gymnastics, Inc. and its representatives to use photos, videos, known as images, taken of you or your child/children in any or all of our Newsletters, Marketing Material, Advertising Material, Newspaper Articles, Web Sites, Social Media and any other types of visual or print publications or advertisements.

The customer (Parent/Guardian) is responsible to bring their child(ren) with their costume(s) to Ronald E. McNair High School to dress rehearsal and recital on time. The show will go on, so please ensure your child is present and ready to perform.

We will have your child measured and sized during their class time. ALL measurements need to be taken by Ms. Leilani or a staff member. Then, based on the sizing chart, the size will be suggested and decided. Sizing charts are suggested fitting for the items and is provided as a general guide by the dance costume manufacture. Alterations may be needed and is the responsibility of parent/guardian.

The SUMMER DANCE RECITAL fee is due and payable when reserving your child's spot. This is NON-refundable or transferable. Each class will be sent individual specific information regarding the registration costume total.

I (we) hereby authorize GymStars Gymnastics, Inc., or assignee hereinafter called COMPANY, to initiate debit entries to my (our) account and financial institution on the voided check or credit card number provided to pay the balance due for my GymStars Dance Recital registration. Transfer of funds will occur today or the next business day dependent on the hours and days of operation of the COMPANY. This authorization is to remain in full force and effect until the COMPANY has received full payment from my financial institution.

Our dance program is ongoing enrollment. Your child may qualify for a new class, and you will be updated when applicable. If you do not wish to continue after the show, we must receive a 30 Day written drop notice in advance through our recital date. Please see our Drop Policy.

I understand that any device larger than a cell phone must be utilized in the "upper level" of the theater ONLY. Failure to so may result in being removed from the theater without refund.

I agree to pick up my dancer at the required time from any rehearsal or concluded show. Failure to do so without notice may result in a late pick-up fee of $5 for every 5 minutes past the communicated pick up time.

I understand that all fees must be paid in full by Wednesday April 16, 2025, by 11:59pm unless otherwise approved by GymStars Management. Failure to do so may relinquish your dancers spot in show.
