I understand that participation in the Nashville Swim Academy Kids’ Triathlon involves physical activity, including but not limited to swimming, running, and biking, as well as participation in outdoor and parking lot environments.

I acknowledge that these activities involve inherent risks, including but not limited to:

Slips, trips, and falls
Collisions with other participants or objects
Bicycle or equipment malfunction
Uneven surfaces and parking lot hazards
Exposure to weather and outdoor conditions

I understand that these risks cannot be completely eliminated, even with reasonable safety measures in place.

I understand that portions of the event take place in areas with controlled but not fully closed traffic, including active or partially active parking lot spaces.

I acknowledge and agree that:

The course is not a closed roadway or fully secured course
Vehicles, pedestrians, and other environmental factors may be present
Nashville Swim Academy will implement reasonable safety measures, but cannot guarantee the elimination of all traffic-related risks

I accept full responsibility for maintaining awareness of surroundings and ensuring my child remains within designated course boundaries at all times.

I agree that a designated caregiver (18 years or older) will actively accompany the participant at all times throughout the event.

I accept full responsibility for:

Supervising my child
Assisting with transitions between event segments
Supporting safe participation and decision-making

I understand and agree that:

A properly fitted helmet is required during the biking portion
All equipment (including bicycles, scooters, and footwear) must be safe and appropriate

I accept responsibility for ensuring all equipment is in good working condition prior to participation.

I represent that I and my child(ren) are in good health and physically able to participate in swimming, biking, and running activities. I understand that pool decks and surrounding areas may be wet or slippery. I certify that I carry health and accident insurance for myself and my child(ren), or I accept full financial responsibility for any medical expenses incurred.

In the event of an emergency, I authorize Nashville Swim Academy and/or the facility owner to obtain emergency medical treatment for myself and/or my child(ren). I understand that I am responsible for all medical costs incurred.

To the fullest extent permitted by law, I hereby release, waive, and discharge:

Nashville Swim Academy, its owners, directors, employees, contractors, and representatives, and its affiliates, property owners, managers, agents, and representatives.

from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in this event.

I agree to indemnify, defend, and hold harmless:

Nashville Swim Academy, and
General Shoe Company and its affiliated property ownership and management entities

from and against any and all claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of:

My child’s participation in the event
Any breach of this agreement
Any negligent or intentional act by me or my child

I authorize Nashville Swim Academy staff to take reasonable action in the event of an emergency, including securing medical treatment for my child if necessary. I understand that I am responsible for any associated costs.

I grant permission for Nashville Swim Academy to use photographs or videos of my child taken during the event for promotional and marketing purposes without compensation.
